Certain Authorities of Religious Minorities in Iran’s Act and the Effects of Their Decisions

يكي از نوآوري هاي قانون جديد حمايت خانواده در ماده 4 اين قانون و در رابطه با مراجع اقليت هاي ديني مشاهده مي شود. در رابطه با صلاحيت اين مراجع و ارتباط آن ها با محاكم قضايي مي توان گفت، اشاره قانون گذار به مراجع خاص اقليت هاي ديني به معناي نفي صلاحيت دادگاه هاي عمومي در رسيدگي به امور اقليت ها بر مبناي قواعد و عادات مسلمه متداوله دين و مذهب متبوع آنان است. علاوه بر اين، با توجه به اينكه اين مراجع صلاحيت رسيدگي به احوال شخصيه و امور حسبي اقليت هاي ديني را دارند و در قانون به رسميت شناخته شده اند، مي توان آن ها را با كمي اغماض، جزوي از نهاد قضاوتي قضايي از نوع استثنايي دانست كه تصميماتشان در دادگاه معتبر است و تا زماني كه مخالفتي با نظم عمومي و اخلاق حسنه نداشته باشد، تنفيذ و اجرا خواهد شد.

Certain Authorities of Religious Minorities in Iran’s Act and theEffects of Their DecisionsOne the innovations in the new act of family support is observed in article 4 for the authorities of religiousminorities. Concerning the competence of these authorities and their relationships with the judicial courts,legislators deny the competence of the general courts in hearing the minority affairs based on their religiouscommonalities and certain rules and habits. Moreover, given that these authorities are competent to hear thepersonal status and non-litigious affairs of the religious minorities and are legally recognized to do so, they canbe, to some extent, considered as an exceptional part of the judicial judgment institution.
