در نظام قانوني آيين دادرسي كيفري فعلي با وجود آنكه سال هاست اهميت قوانين شكلي در حد قوانين ماهوي دانسته مي شود، قانون گذار هنوز نپذيرفته است كه اين دو نوع قانون اهميت يكساني دارند. بر مبناي اين عدم پذيرش، نقض قوانين ماهوي همواره موجب بي اعتباري راي دادگاه است؛ اما نقض قواعد شكلي تنها در صورتي كه به درجه اي از اهميت باشد كه موجب بياعتباري راي شود، ميتواند موجب نقض راي گردد. اما سوال اين است كه اين تشريفات با درجه اهميت بالا كدامند؟ معيار هاي گوناگوني مي توان براي تشخيص اين تشريفات تصور كرد. معياري كه بر اساس آن تشريفات، با درجه اهميت بالا محسوب مي شود كه نقض آن ها موجب نقض يك قانون ماهوي است، معياري است كه با متن قانون فعلي و قوانين سابق بيشتر تطبيق دارد؛ اما معياري كه بر اساس آن تشريفات با درجه اهميت بالا همان اصول بنيادين دادرسي اند، با اهداف آيين دادرسي كيفري مطابقت بيشتري دارد.
