A Study of Katf in the Holy Quran and the Law of Islamic Punishment

خطف و آدم ‌ربايي در همه دوران‌ها أمري رايج بوده كه با انگيزه‌هاي مختلف انجام مي‌شده است. مشتقات واژه «خطف» در سه‌جاي قرآن آمده است. اين مقاله به‌دنبال بررسي خطف در قرآن كريم و قانون مجازات اسلامي است. آيات متعددي بيانگر آن است كه انسان داراي كرامت است و بر پايه اين أصل، انسان آزاد است و كسي حق ربايش و سلب آزادي از او را ندارد. اين نگاه قرآني در حالي است كه در جامعه جاهلي عصر نزول آدم‌ربايي أمري مرسوم بوده است. قرآن كريم با اين پديده به مبارزه برخاست و با عنايت به دستورات معصومان قوانين مختلفي در اين باره وضع گرديد، چنانكه در حال حاضر از نظر قانوني براي مجازات مرتكبان به اين جرم به‌صورت خاص، يك ماده و به‌صورت عام، چندين ماده از قانون مجازات اسلامي اختصاص يافته است و در منابع قوانين كيفري عليه آدم‌ربايان مصوبات فراواني وضع شده است

The abduction mentioned in the Holy Qur'an by the word "khatf" has been a common practice throughout the world with various motives. The derivatives of this word have appeared in three cases of the Qur'an. This article seeks to examine the Holy Quran and Law of Islamic Punishment. Numerous verses of the Holy Qur'an state that man has dignity and that on this basis, man is free and no one has the right to kidnap and deprive him of his liberty. This is the view of the Qur'an while abduction has been common in the ignorant society of the revelation era. The Holy Qur'an fought against this ominous phenomenon, and in accordance with the orders of the infallibles (as), various laws were introduced, as it is now seen that there is a legal provision for punishing those of this crime in particular. In general, several articles of the Law of Islamic Punishment have been enacted and numerous sources have been adopted in criminal law sources against abductors..
