The comparative study of Limitations of Financial Rights of Neighboring Rights Copyright

صاحبان حقوق مجاور يا مرتبط با حقوق ادبي‌ و هنري همچون پديدآورندگان آثار ادبي ‌و هنري، از حقوق مالي انحصاري برخوردار هستند. با اين ‌همه، اين سؤال مطرح است كه آيا منافع عمومي از قبيل اصل آزادي بيان و اصل آزادي دسترسي به اطلاعات و نيز مصالح خصوصي محدوديت‌هايي نسبت به حقوق مالي در عرصه حقوق مجاور ايجاد مي‌كند. اين جستار با روش توصيفي- تحليلي، محدوديت‌هاي پيش‌بيني‌شده در حقوق فرانسه را به‌عنوان كشوري پيشرو در اين زمينه و نيز اسناد بين‌المللي مرتبط تبيين و تحليل كرده و به اين نتيجه دست يافته است كه محدوديت‌هاي پيش‌بيني‌شده در حقوق مجاور بر دو دسته است؛ برخي داراي ماهيت استثنا به معني واقعي كلمه و بدون نياز به پرداخت هرگونه مابه ‌ازا است در حالي كه برخي ديگر منوط به پرداخت عوض عادلانه و با سازوكار ويژه است. به علاوه، بر اساس دستاورد حاصل از پژوهش، وضع موجود حقوق ايران تبيين شده و لايحه حمايت از مالكيت فكري مصوب 1393 نيز نقد و راه‌كارهايي براي نيل به وضع مطلوب ارائه شده است.

The owners of neighboring copyrights have exclusive economic rights. Nevertheless, some limitations such as rights of free speech, freedom of information access and other personal benefits caused by public interests come to limit these rights. Part of these limitations can be categorized as the exceptions which do not need to pay any consideration. However, another parts require to follow certain rules and call for compensation. This article explains the limitations set forth in French Law since France has pioneered this area of law.. following that, a comparative enquiry is made into the Iranian bill of "Protection of Intellectual Properties" enacted in 2014 (1393). In the light of this comparative study, some solutions will be proposed for amending the existing rules.
