معيار شهرت عمومي در دعاوي مسؤوليت مدني ناشي از بدگويي و نقض حريم خصوصي (مطالعه تطبيقي در حقوق ايران و آمريكا)

Defemation, Privacy, and the Role of Public Figures: A Comparative Study of Iran and the U.S. Legal Systems

يكي از اهداف نظام­ هاي حقوقي پاسداري از حيثيت، اعتبار و حريم خصوصي افراد جامعه است. از ديگر سو، ‌لزوم در نظر گرفتن نفع جامعه در كسب اطلاعات و آزادي بيان انكارناپذير است. تقابل اين دو آرمان مي­تواند موجب طرح دعاوي جبران خسارت مدني شود. در حقوق مسؤوليت مدني آمريكا، با تفكيك شخصيت­هاي مشهور از ساير افراد، كوشش شده است تا تعادلي نسبي ميان حق بر آزادي بيان و اطلاع رساني، از يك سو و حق بر جبران خسارت به دليل لطمه به حيثيت، از ديگر سو برقرار شود. اين مقاله بر آن باور است كه دادگاههاي مدني ايران مي­توانند در دعاوي جبران خسارت از سوي اشخاص مشهور، براي صدور رأي به جبران خسارت به دليل ورود ضرر معنوي و آسيب به حيثيت اين دسته از اشخاص، معيار سرسختانه­تري را اعمال كنند. اعمال معيار شهرت عمومي در عرصه مسؤوليت مدني بستر تبادل آسان­تر اطلاعات را راهم و از طرح پاره­اي دعاوي در نظام قضايي پيشگيري خواهد كرد. اين رويكرد البته لطمه­ اي به امكان جبران خسارت افراد، كه نياز بيشتري به حمايت قانوني دارند، وارد نمي­كند.

Legal systems around the world have adopted different approaches to protecting the privacy and integrity of citizens. However, protecting these values at times runs into conflict with principles such as freedom of speech and access to information. Moreover, the rise of social media platforms has intensified this conflict. In the U.S., the recognition of "public figure" and “actual malice” standard in defamation and privacy lawsuits has been a critical move in balancing the different values at stake. This Article studies the role of public figure standard in the U.S. defamation and privacy laws. It proposes that recognizing the differences between public figures and private persons in Iran’s tort law system can also help balance the various interests of the Iranian society and reduce the floodgate of defamation lawsuits. This approach will not undermine the right of private individuals who need the legal system’s guaranteed protection of their reputation and privacy.
