Legal requirements for publication of oral history interviews in the cyberspace

هدف: شناسايي جنبه‌هاي حقوقي انتشار مصاحبه‌هاي حاصل‌از تاريخ شفاهي درفضاي مجازي روش/ رويكرد پژوهش: مسائل حقوقيِ انتشار مصاحبه‌ها در فضاي مجازي با مطالعۀ منابع موجود شناسايي و تشريح شده‌ است. سپس قوانين مربوط به استفاده از اسناد تاريخ شفاهي در پايگاه‌هاي اطلاعاتيِ مراكز آرشيوي، شامل مركز آرشيوي ميلر، آرشيو ملي سنگاپور، دانشگاه هاروارد، تاريخ شفاهي ناسا، سازمان اسناد و كتابخانۀ ملي جمهوري اسلامي ايران بررسي شده ‌است. يافته‌ها و نتيجه‌گيري: در گردآوري مصاحبه‌ها و انتشارشان در فضاي مجازي رعايت اين نكات اهميت دارد: آگاهي راوي از اهداف مصاحبه، يادآوري مسائل حقوقي در ابتداي ضبط مصاحبه، كسب اجازه از راوي براي انتشار مصاحبه در فضاي وب، توجه به رعايت نكات اخلاقي در انتشار مصاحبه‌هاي برخط، آشنايي متصديان نشر الكترونيكي با پايگاه‌هاي داده و نيز تدوين سياست‌گذاري مناسب پيش ‌از نشر منابع.

Purpose: This paper discusses legal requirements for online publication of oral history interviews. Method and Research Design: Issues relating to the publication of oral history interviews were identified from library resources. Then the websites of the Miller Archival Center, National Archives of Singapore, University of Harvard, NASA Oral History Center, and the National Archives of Iran were checked for their regulations regarding the publication records of oral history documents. Findings and Conclusion: The considerations with regard to the carrying out and publication of interviews are important: The narrator must be made aware of the purpose of the interview; legal issues should be mentioned at the beginning of the interview, seeking the permission of the narrator for releasing the content of the interview on the web, complying with the ethical issues, familiarity of those responsible for electronic publication with databases and having a policy statement before release.
