تحليل موانع حقوقي و قانوني اثرگذار بر اجراي سياست‌هاي كلي اصل 44 قانون اساسي در فوتبال حرفه-اي جمهوري اسلامي ايران

The Analysis of Legal Barriers Affecting the Implementation of General Policies of Article 44 in Iran Professional Football

هدف از اين پژوهش بررسي و تحليل موانع حقوقي و قانوني اثرگذار بر اجراي سياست‌هاي كلي اصل 44 قانون اساسي در فوتبال حرفه‌اي جمهوري اسلامي ايران بود. با توجه به هدف اصلي پژوهش، روش انجام پژوهش از نوع كيفي بود. به اين منظور، با انجام مصاحبه‌هاي كيفي با خبرگان و متخصصان امر، مهم‌ترين موانع حقوقي و قانوني موجود در مسير پياده‌سازي سياست‌هاي كلي اصل 44 قانون اساسي، در فوتبال حرفه‌اي كشور شناسايي شد. در پژوهش حاضر، نمونه‌گيري از افرادي انجام گرفت كه مربوط‌ترين داده‌ها را، دربارة موضوع پژوهش فراهم مي‌كردند. در پژوهش حاضر از نظرهاي 26 نفر از افراد، در قالب 35 مصاحبه استفاده شد و زماني‌كه موضوع به‌حد اشباع نظري رسيد، فرايند جمع‌آوري يافته‌ها پايان يافت. مطابق با مباني پژوهش‌هاي كيفي، تحليل يافته‌ها همزمان با جمع‌آوري داده‌ها انجام گرفت. يافته‌هاي پژوهش نشان داد، مهم‌ترين موانع حقوقي و قانوني مؤثر در اجراي سياست‌هاي كلي اصل 44 قانون اساسي عبارت بودند از: جامعنبودنقوانينمصوبمربوطبهخصوصي‌سازي؛ تغييرات مكرر در قوانين تصويب‌شده؛ وجود مشكلات قانوني در خصوص قوانيني چون حق پخش تلويزيوني و حقوق مالكيت معنوي (كپي‌رايت)؛ وجود برخي اشكالات و نواقص در قوانين و مقررات مربوط مانند قانون كار، قانون ماليات و قانون مديريت خدمات كشوري؛ قديمي بودن قانون تأسيس و ادارۀ وزارت ورزش (سازمان تربيت بدني) و باشگاه‌هاي ورزشي؛ تعدد مراجع تصميم‌گيري در زمينة خصوصي‌سازي و واگذاري باشگاه‌هاي حرفه‌اي؛ ناهماهنگي و همسو نبودن مقررات و سياست‌هاي اجرايي؛ كمبود قوانين نظارت و بازرسي جهت كنترل فرايندهاي اجرايي سياست‌هاي كلي اصل 44؛ نامشخص بودن وضعيت مالكيتي بسياري از باشگاه‌ها از منظر حقوقي؛ وجود مشكلات حقوقي در ثبت قراردادها و كم‌كاري دولت و وزارت ورزش در ارائة لايحه‌هاي مؤثر و كارامد.

The aim of this study was to analyze the legal barriers affecting the implementation of general polices of article 44 in Iran professional football. With respect to the main aim of the study, the methodology was qualitative. Authorities and experts underwent qualitative interviews and the most important legal barriers to the implementation of general policies of article 44 in Iran professional football were identified. The sample consisted of those who had the most relevant data of the subject of the study. The viewpoints of 26 subjects in the framework of 35 interviews were used and data collection was finished until theoretical saturation. In accordance with qualitative researches, data were analyzed simultaneously with data collection. Results showed that the most important legal barriers to the implementation of general policies of article 44 included the lack of comprehensive rules and regulations of privatization, continual changes in rules and regulations, legal problems of TV rights and copyright, some problems and deficits in rules and regulations such as labor law, tax rules and service management rules, outdated rules of the establishment and management of Sport Ministry (Physical Education Organization) and sport clubs, multiplicity of decision makers in privatization and resignation of professional clubs, inconsistency of executive rules and policies, lack of control and supervision rules to control the implementation processes of general policies of article 44, indeterminate ownership of most clubs from legal viewpoint, legal problems in contract registration, indolence of the government and Sport Ministry to present effective and efficient bills.
