چكيده فارسي :
مرور تاريخ نشان مي‌دهد بيان نظريات، معرفي اختراعات و توليد دانش جديد در زمينه يك پديده غيرعادي و غيرمحتمل، همواره آشوب و آشفتگي در بين دانشمندان و فقها و مذاهب مختلف به دنبال داشته است. در مورد مسأله شبيه‌سازي انساني نيز چنين رويدادي دور از انتظار نبود. فناوري شبيه‌سازي انساني از طريق دانش موجود، نگراني‌ها و دغدغه‌هاي روزافزوني را در بين دانشمندان و انديشمندان دين، اخلاق و حقوق به وجود آورده است كه احكام آن به بررسي و مداقه نياز دارد. هدف پژوهش حاضر بررسي آثار و احكام شبيه‌سازي از ديدگاه‌هاي مختلف است، زيرا اين پديده از مسائل ناپيداي فقه و حقوق است كه احكام و آثار آن به بررسي‌هاي بيشتري نياز دارد. از احكام حقوقي انسان شبيه‌سازي‌شده در متون مورد بررسي مي‌توان به نسب، ارث، اهليت، وصيت، حضانت و نفقه اشاره كرد. بر اساس يافته‌هاي پژوهش در زمينه احكام و آثار حقوقي شبيه‌سازي بايد گفت كه انسان‌هاي ناشي از شبيه‌سازي از منظر احكام حقوقي هيچ تفاوتي با ساير اشخاص ندارند و مهم‌ترين اثر حقوقي شبيه‌سازي انسان، مسأله تحقق نسب شبيه است. بدين لحاظ كه نسب، حقيقت شرعيه نيست، بلكه يك مفهوم عرفيه است؛ نسب شبيه در صور مختلف شبيه‌سازي مولد محقق بوده و شبيه به پدر و مادر طبيعي خود ملحق و منتسب است و عرف هر كسي را كه مادر يا پدر شبيه بداند، شبيه به آن فرد منتسب و ملحق خواهد شد.

Throughout history, the expression of theories, inventions, and the production of new knowledge in the context of an unusual and unlikely phenomenon has always been a source of chaos among scholars and jurists. As for the human cloning issue, such an event was not unexpected. Human cloning technology, through existing knowledge, has created increasing concerns and concerns among scholars and scholars of religion, ethics and law, whose judgments require scrutiny. Investigating the effects and judgments of this phenomenon from different points of view is the subject of this research because it is one of the hidden issues of jurisprudence and law that its judgments and effects need further investigation. The legal rulings of the simulated human can be related to kinship, inheritance, nobility, will, guardianship and alimony. Regarding the legal effects and effects of simulation, it should be said that the human beings caused by the simulation have no difference from the point of view of legal provisions and that the most important legal effect of human simulation is the realization of similar ancestry. Because kinship is not the truth of the law but is a mystical concept, kinship is similar in many ways to being a productive scientist and is similar to that of his or her natural parent, and the custom of anyone who considers mother or father alike. That person will be ascribed and joined.
