بررسي چالش‌هاي حقوق كيفري در جرائم مواد مخدر در ايران

Investigating the Challenges of Criminal Law in Drug Crimes in Iran

هدف پژوهش تعيين قلمرو حقوق كيفري است. سطح مجاز مداخلۀ حقوق جزا به‌عنوان شديدترين نوع مداخله در حقوق و آزادي­ هاي شهروندان با پيچيدگي­ ها و دشواري‌هاي متعددي مواجه است. اصل حداقل بودن حقوق جزا به‌عنوان يكي از اصول بنيادين اين دانش، فن و ابزار كنترل اجتماعي با تاكيد بر آثار سوء‌مصرف مفاهيم، ابزارها و نهادهاي حقوق كيفري در تلاش است تا قلمرو مجاز حقوق كيفري را تعيين نمايد، روش پژوهش حاضر توصيفي و تحليلي و ابزار گردآوري اطلاعات كتابخانه ­اي و به صورت فيش برداري است. پژوهش حاضر با توجه به سؤال اصلي كه مطرح مي­ شود اين است كه رويكرد حقوق كيفري ايران در مبارزه با جرائم مواد مخدر با چه چالش هايي مواجه است و اين فرضيه را مي توان مطرح كرد كه هزينه­بردار بودن، گستردگي فراواني جرائم، عدم تطابق جرم با مجازات و عدم دستيابي به بازده مناسب از مهم‌ترين چالش‌هاي ورود حقوق كيفري در جرائم مرتبط با مواد مخدر است.

The purpose of the study is to determine the territory of criminal law. The permissible level of criminal law intervention, as the most severe form of interference with the rights and freedoms of citizens, faces many complexities and difficulties. The principle of minimum criminal law as one of the fundamental principles of this knowledge, technique and tool of social control, with emphasis on the misuse of the concepts, tools and institutions of criminal law, is trying to determine the permissible territory of criminal law. Data collection is library-based and vector-coded. The present study, with respect to the main question that arises, is what are the challenges facing the criminal law of Iran in the fight against narcotics and it can be hypothesized that the cost-effectiveness, the wide range of crimes, the lack of Adjusting crime to punishment and failure to achieve proper returns are one of the most important challenges for criminal law entry in drug-related crimes.
