راهكارهاي مقابله با تاثيرات تغييرات آب و هوايي و گازهاي گلخانه‌اي بر محيط ‌زيست ايران از منظر حقوق بين الملل و حقوق ايران

Strategies to counter the effects of climate change and greenhouse gases on Iran's environment from the perspective of international law and Iranian law

با توجه به نقش و اهميت كليدي محيط ‌زيست در ارتقا كيفي حيات بشري، پرداختن به دغدغه هاي محيط ‌زيستي كه موجبات نگراني بين المللي را فراهم نموده از ضرورت برخوردار گرديده است. بدون ترديد يكي از مقوله‌هايي كه باعث تنزل كيفيت محيط ‌زيست گرديده تغييرات آب و هوايي گازهاي گلخانه‌اي است. لذا در اين نوشتار به بحث پيرامون دلايل و پيامد هاي تغييرات آب و هوايي و گازهاي گلخانه‌اي و اقدامات بين‌المللي جهت مقابله با آن‌ها پرداخته شده است. در سطح بين المللي مهم‌ترين اين فعاليت‌ها تصويب دو سند بين المللي تحت عنوان كنوانسيون كليات تغييرات آب و هوا و پروتكل كيوتو هستند كه راهكارهاي مناسبي در خصوص كاهش گازهاي گلخانه‌اي و انطباق را ارائه نموده‌اند. با توجه به اهميت كاهش تغييرات آب و هوايي و گازهاي گلخانه‌اي ايران نيز به اين دو سند حقوقي بين المللي پيوسته است و در راستاي انجام تعهداتش نسبت به تاسيس دفتر طرح ملي تغيير آب و هوا اقدام و تا به حال نسبت به تهيه و ارائه دو گزارش ملي در اين زمينه اقدام نموده است. از آن جا كه تغييرات آب و هوايي تهديدي بزرگ براي سلامت محيط ‌زيست و حيات بشري به شمار مي رود لذا تعهد جامعه بين المللي در خصوص مقابله با اين پديده نوعي از تعهدات ارگاامنسي محسوب و ضرورت پرداختن به اين بحث را دو چندان مي‌سازد.

Given the key role and importance of the environment in improving the quality of human life, addressing the environmental concerns that have caused international concern has become essential. Undoubtedly, one of the categories that has degraded the quality of the environment is the climate change of greenhouse gases. Therefore, in this paper, the causes and consequences of climate change and greenhouse gases and international measures to deal with them are discussed. At the international level, the most important of these activities are the adoption of two international instruments, the General Convention on Climate Change and the Kyoto Protocol, which provide appropriate solutions for reducing greenhouse gases and adaptation. Due to the importance of reducing climate change and greenhouse gases in Iran, it has joined these two international legal documents and in line with its obligations to establish the office of the National Plan for Climate Change and has so far prepared and submitted two reports. Melli has taken action in this regard.Because climate change poses a major threat to environmental health and human life, the commitment of the international community to address this phenomenon is a kind of ergonomic commitment that doubles the need to address this issue.
