كوچك سازي دولت؛راهبردي موثر براي تراكم زدايي حقوقي - اداري از تهران

Government Downsizing: Effective Strategy for Legal-Administrative De localisation of Tehran

به نظر يكي از راهكارهاي اصولي جهت نيل به تراكم ‌زدايي از تهران كوچك‌سازي (چابك‌سازي) دولت مي‌باشد. راهبردي كه هرچند در قوانين موضوعه كشور بر آن تصريح شده است اما با ساختار متمركز موجود و تفاسير محدود نگري كه نسبت به صلاحيت‌هاي واحدهاي اداري محلي، سازمان‌هاي مردم‌نهاد و ... صورت مي‌پذيرد، امكان دستيابي به اهداف سند چشم‌انداز كشور و تحقق سياست‌هاي كلي نظام در حوزه كوچك‌سازي دولت وجود نخواهد داشت. از اين‌رو بازانديشي در مورد الگوي اداره كشور و باز مهندسي نظام اداري و اجرايي با رويكرد عدم تمركز ضرورتي محتوم است. براي نيل به كوچك‌سازي مي‌بايست از مستندات قانوني مربوطه از جمله: بند 10 اصل سوم قانون اساسي، بند 10 سياست‌هاي كلي نظام اداري و ساير قوانين موضوعه در زمينه كوچك‌سازي دولت، اعمال دولت الكترونيك و تمركززدايي، در عمل بهره جست تا بتوان به يك تراكم‌زدايي حقوقي- اداري دست يافت. در اين پژوهش با رويكرد توصيفي- تحليلي و كاربردي، سعي مي‌شود بر امكان‌سنجي تراكم‌زدايي از تهران در پرتو تحقق كوچك‌سازي دولت پرداخته شود. فرض اصلي مقاله بر اين مبنا استوار است كه درصورت اجراي قوانين مرتبط با حوزه كوچك‌سازي دولت و صرف فعل خواستن از جانب مسئولين ذي ‌ربط، تراكم ‌زدايي از تهران دور از دسترس نخواهد بود.

Downsizing of governments is one of the basic solutions for obtaining the goal of delocalization of Tehran. A strategy, however confirmed in Iranian positive laws, is obstructed with legal-political, administrative structure, limited interpretations about qualifications of local-administrative units and NGOs etc. Thus, rethinking and revising the pattern for administration of Iran and reengineering legal and executive system through decentralization is an undeniable necessity. In order to obtain this task, it’s possible to benefit from related legal documents including: Paragraph 10 of 3rd Principle of the Constitution, Paragraph 10 of the General Policies of Administrative System and other positive laws for downsizing the government, E-government and the decentralization. In the present research, by descriptive- analytical and applied approach, a feasibe study of delocalization of Tehran with government downsizing is emphasized. The main hypothesis of this research is that delocalization of Tehran is possible if the related rules of government downsizing by the related authorities is executed.
