The Carrier’s Duty of Customs Summary Declaration

در حمل و نقل بين‌المللي بار، كالا به واسطه عبور از مرزهاي كشورها موضوع كنترل­ و تشريفات گمركي قرار مي­ گيرد. تكليف اصلي انجام تشريفات گمركي بر دوش خود صاحب بار قرار دارد. ليكن قوانين گمركي در بيشتر كشورها، متصديان حمل بين المللي را ملزم ساخته‌‌اند تا به محض ورود به قلمرو گمركي، بدوا كالا را اظهار اجمالي نموده به طوري كه تا پيش از آن تخليه بار ميسر نمي­ باشد. هدف از نگارش اين مقاله روشن ساختن مبنا، شرايط و آثار «اظهار اجمالي كالا» از سوي متصدي حمل است كه تاكنون در ادبيات حقوقي ايران به آن توجه نشده است. با بررسي شرايط و ضمانت اجراي قانونيِ اظهار اجمالي از سوي متصدي حمل، ابتناي اين تعهد بر اسناد حمل مربوطه (بارنامه يا راهنامه) مشخص گرديد و ثابت شد كه توصيفات فرستنده بار در چنين اسنادي مبنا و تعيين كننده ميزان مسئوليت متصدي حمل در مقابل مراجع گمركي قرار مي­گيرد. نوآوري اين مقاله در آن است كه يك قاعده حقوق گمركي را از زاويه حقوق حمل و نقل و با اتكا به قواعد آن مورد تجزيه و تحليل قرار داده است.

The goods shall be subject to customs formalities while crossing national borders in international transportation. The main duty to meet the above formalities lies against the cargo owner which, in deed, is assignable to an agent _ who might be the carrier. However, the carrier itself is obliged to submit a summary declaration of the total cargo before the customs authorities prior to the cargo unloading. The summary declaration is submitted based on the transport documents so that the governing rules could only be construed in line with the transportation law. The legal basis of summary declaration, the exemption from this duty, the carrier who shall declare, the legal nature of manifest and the remedy of non- compliant declaration are some of the issues that are dealt with in this article. This article is distinct in this respect that it has analyzed a customs legal rule from the perspective of transport law.
