تعهدات فرهنگي دولت ها در حقوق بين الملل با تاكيد بر آراي ديوان بين المللي دادگستري در زمينه حق هاي فرهنگي

Cultural Contracts of Governments in International Law with Emphasis on International Criminal Court Judgments on Cultural Rights

مقدمه و هدف پژوهش: بررسي ابعاد حقوقي تعهدات فرهنگي دولت‌ها در حقوق بين‌المللي به دليل پيچيدگي‌هايي كه دارد، يكي از چالش برانگيزترين مسائل پيش روي ديوان باشد.اين پژوهش با هدف اينكه محاكم بين‌المللي تا چه اندازه در پرداختن به حق‌هاي فرهنگي كه نمونه بارز تعهدات فرهنگي دولت‌ها است مصمم وجدي هستند و چالش‌هاي آنها در خصوص اين موضوع چيست شروع شد. روش پژوهش: روش پژوهش تحليلي - توصيفي از نوع كتابخانه‌ايي است. يافته‌ها: پژوهش حاصل از اين مقاله نشان مي‌دهد كه تعهدات فرهنگي دولت‌ها در حقوق بين‌الملل صرفا تعهداتي انتزاعي و تئوريك نيستند بلكه تعهداتي عملي هستند كه اين موضوع در آراي ديوان انعكاس يافته است. نتيجه‌گيري: صرف پرداختن به تعهدات فرهنگي دولت‌ها در حقوق بين‌الملل بدون اشاره موردي به دستاوردهاي ديوان، تكرار است.

Study of legal dimensions of governments cultural commitments in international rights, because of it’s complications, is the most challenging questions in the ICJ. This research started for the answer of this question: “HOW the international low courts are resulted to address the surroundings of cultural rights- that are the obvious samples of governments cultural commitments – and what are it’s challenging of this questions” Research method: Analytical-descriptive research method is a type of library. Findings: The research OF this article shows governments cultural commitments in international rights aren’t just abstract and theologian commitments; but also are practical commitments which are reflected in votes of the bureau Conclusions: just (the) address the surroundings governments cultural commitments in international rights not for certain mention of achievements of bureau is a false repeat.
