چكيده فارسي :
زمينه و هدف: ربات‌هاي جنسي ابزارهاي خودارضايي مدرن با حداكثر مشابهت جسمي با نمونه‌هاي انساني هستند كه بازار محصولات سكس را اشباع نموده‌اند. هدف از توليد اين محصولات برآورده‌كردن تمايلات جنسي افراد (اعم از شهروندان عادي و افراد داراي معلوليت و نقص) و نيز رفع خلأهاي عاطفي عنوان شده است.
مواد و روش‌ها: در اين مطالعه تحليلي، منابع و مقالات منتشرشده مرتبط به صورت هدفمند جستجو و بازيابي شده و سپس توجيهات موافق و مخالف با توليد و استفاده از ربات‌هاي جنسي از منظر اخلاقي و حقوقي مورد بحث و نقد قرار گرفت.
يافته‌ها: از منظر موافقان اخلاقي‌بودن رابطه با ربات‌هاي جنسي، اولاً مطابق با خودمختاري فرد و احترام به آزادي انتخاب او است؛ ثانياً از حيث سودمندي، اين ربات‌ها داراي كاركردهاي مثبتي همچون حمايت از زنان و نهاد خانواده، جايگزين مناسب ازدواج براي افراد فاقد توانايي تشكيل خانواده، پيشگيري از جرائم جنسي و نيز درمان برخي بيماران هستند؛ ثالثاً به كارگيري ربات‌هاي مذكور هيچ ضرر جسمي و روحي را به دنبال نخواهد آورد؛ رابعاً زمينه عدالت جنسي و بهره‌مندي همه اقشار جامعه از لذت مقاربت را فراهم مي‌آورد. در مقابل، مخالفان با رد توجيهات فوق معتقدند كه رواج اين ربات‌ها، مخالف با طبيعت انسان بوده و نسبت به فوايد محتمل، مضرات بيشتري همچون افزايش حس تنهايي در فرد، از بين رفتن نهاد خانواده و تلون مزاج را به همراه خواهد آورد؛ مضافاً آنكه به دليل عدم ارضاي كامل فرد رضايت يكسان عمومي را موجب نخواهد شد. از نظر حقوقي، برخي از حقوقدانان، رابطه جنسي با ربات‌ها را مشمول عنوان مجرمانه جريحه‌داركردن عفت عمومي موضوع ماده 638 قانون تعزيرات مصوب 1375 مي‌دانند و حال آنكه صدق اين عنوان محل تأمل است.
ملاحظات اخلاقي: ملاحظات مربوط به اخلاق در پژوهش و نيز امانت در استناد به متون و ارجاع به منابع رعايت گرديد.
نتيجه‌گيري: هرچند ربات‌هاي جنسي داراي برخي كاركردهاي مثبت هستند، ليكن به دليل آثار منفي بيشتري كه به دنبال دارند، در كنار اخلاق‌گرايي قانوني و نيز ملاحظات مذهبي، گزينه‌اي غير اخلاقي محسوب مي‌شوند. در حقوق كيفري ايران نيز نمي‌توان به آساني، رابطه جنسي با ربات‌ها را منطبق با عنوان مجرمانه خاصي دانست.

Background and Aim: The sexual robots are modern masturbation tools
with maximum physical similarity with human samples that have saturated
the market of sex products. The aim of producing these products is to
satisfy individuals' sexual desires (ranging from ordinary citizens and
persons with disabilities) and to eliminate emotional gaps.
Materials and Methods: In this review study, relevant and published
articles were purposely searched and retrieved, and then ethical arguments
for and against sex with sexbots were discussed and criticized from a
principlist approach.
Findings: From the perspective of pros and cons, the robots firstly are in
respect of human autonomy; secondly have positive functions such as
protecting women and family entities, proper marriage substitutes for people
who lack the ability to form family, preventing sexual crimes and treating
some patients; thirdly they never result in harm; and finally using sex robots
help in sex justice in society. On the other hand, according to opposition,
the popularity of such robots is against human nature and more than
probable benefits have disadvantages like increase in loneliness of
individuals and destroying the family. Furthermore they will never satisfy the
full satisfaction of the individual. Legally, some jurists consider the sex
relationship with robots as criminal under the title of “Outraging Public
Chastity” (Art 638) but it seems doubtful.
Ethical Considerations: Authenticity of the texts, honesty and
confidentiality has been observed in this study.
Conclusion: Although, sexual robots have some positive functions, but
because of the more negative effects they pursue, alongside the legal
moralism and religious considerations, they are considered an immoral
option. In the Iranian criminal law, it is not easy to recognize of special title
to punish sex with sexual robots
