The Principles of Administrative Law in the Tradition and Conduct of the Infallibles (P.B.U.T)

حقوق اداري به عنوان بازوي اجرايي حقوق اساسي، از اهميت ويژه‌اي برخوردار است. به سبب تحوّل و پويايي حقوق اداري، لازم است اصول و قواعد اين شاخه از علم حقوق استخراج گردد تا در سير تحول احكام، مصاديق و امور جزئي به سهولت و سرعت تشخيص داده شود. در رابطه با اصول حقوق اداري در غرب، آثاري به انگليسي و فارسي نگارش يافته است. سوال اصلي مقاله اين است كه اصول مزبور در سيرة حكومتي معصومان عليهم السلام كدام است؟ و چه جايگاهي دارد؟ مقالة حاضر با رويكرد توصيفي- تحليلي و با روش كتاب‌خانه‌اي، به تبيين اصول حقوق اداري در سيرة معصومان(ع) مي‌پردازد. نتيجة نهايي پژوهش حاضر آن است كه برخي اصول حاكم بر حقوق اداري عبارتند از: حاكميت قانون، عدالت، گزينش بهترين‌ها، نظارت. اين اصول با نگاه الهي تبيين شده و داراي ضمانت اجراي حقوقي در سيرة معصومان عليه السلام هستند.

Administrative rights as an executive arm of basic rights are of particular importance. Due to the evolution and development of administrative law, it is necessary to extract the principles and rules of this law from the science of law to be recognized in the course of the evolution of rules, instances, and minor affairs in an easy and fast way. In connection with the principles of administrative law in the West, research has been conducted in English and Persian. The main question of the paper is what are the principles of administrative law in the governmental conduct of the infallibles (P.B.U.T)? an‎d what status do they have? Using a descriptive-analytical and desk-research method, this paper studies the principles of administrative law in the conduct of the infallibles (P.B.U.T). The findings indicate that some of the governing principles of administrative law are: rule of law, justice, choosing the best and supervision. These principles are explained with a Divine look and have a legal guarantee in the conduct of the infallibles (P.B.U.T).
