احترام به حقوق شهروندي و حريم خصوصي افراد جامعه و پذيرش كليت اين مهم از شاخصه‌هاي حياتي است كه مورد اجماع همه جوامع بشري بوده و اين امر با وجود تنوع فرهنگي ، سياسي و اجتماعي كشورها ناديده گرفته نمي‌شود . بديهي است در ادبيات سياسي و حقوقي دولت‌ها ، حقوق و امتيازات شهروندان از جايگاهي ممتاز برخوردار است . حقوق شهروندي به حقوق و آزادي‌هايي گفته مي‌شود كه دولت اجراي آن را طبق قوانين داخلي ، براي اتباع خود تأمين و تضمين مي‌كند و محتواي آن ممكن است از يك كشور تا كشور ديگر متفاوت باشد . پيشگيري از جرم در يك جامعه مردم سالار نبايد با صيانت از حقوق شهروندي در تعارض بوده و به نوعي موجب تعدي به اين حوزه شود ؛ البته اين امر به آن معنا نيست كه برخورداري از حقوق مذكور مطلق بوده و هيچ گاه با محدوديت همراه نيست ؛ زيرا در برخي شرايط استثنايي و در كشاكش بين منافع ملي و فردي ، مي‌توان قائل به اعمال برخي نحديدها بود كه حدود و ثغور آن نيز مي‌بايست توسط قانون گذار مشخص شده باشد .
