هدف اصلي از اين پژوهش بررسي ميزان رعايت حقوق متهم از ديدگاه شهروندان، متهمين و ماموران در كلانتريهاي شهر بناب بود كه براساس قوانين موجود مخصوصا آيين دادرسي كيفري مصوب 1392 تا چه ميزان از سوي ماموران كلانتريهاي شهرستان بناب نسبت به حقوق متهمان توجه شده است؟ روش اين پژوهش ، توصيفي- پيمايشي ميباشد كه به صورت ميداني انجام شده است. جامعه آماري مورد مطالعه شامل 50 نفر از پرسنل نيروي انتظامي شهرستان بناب، 50 نفر از متهمين در شهرستان بناب و 50 نفر از شهرونداني كه به نوعي در كلانتري و پاسگاهها داراي پرونده قضايي بودند به صورت در دسترس انتخاب شدهاند. براي جمعآوري اطلاعات از پرسشنامه محقق ساخته استفاده شد كه شامل 50 سوال بود. روايي پرسشنامهها توسط اساتيد صاحب نظر و پايايي پرسشنامه با آلفاي كرونباخ بدست آمد. براي تحليل دادهها علاوه بر شاخصهاي آمار توصيفي از آزمون آنوا نيز استفاده شد. رابطه معناداري بين عملكرد ضابطين در مرحله تحت نظري، دستگيري، بازجويي و رعايت حقوق شهروندي وجود ندارد. ولي بين عملكرد ضابطين در مرحله احضار، جلب، بازرسي و تحقيقات محلي و رعايت حقوق شهروندي رابطه معناداري وجود دارد. پليس، سازماني دولتي است كه اختيارات آن را قانون تعيين ميكند و از جمله وظايف خطير اين نهاد در هر جامعه، انجام تحقيقات مقدماتي با هماهنگي و نظارت مقام صالح قضايي است.
در نهايت نتايج بررسيها نشان داد كه بين رعايت حقوق شهروندي از سوي پليس و تحقيقات مقدماتي پليس در مراحل دستگيري، تحت نظري و بازجويي رابطه معناداري وجود ندارد و اين نشان دهنده آن است كه ضابطين در خصوص آنها عملكرد خوبي را ندارند و يا رعايت نميكنند. در خصوص مراحل: احضار، جلب و بازرسي و تحقيقات محلي، رابطه معناداري بين رعايت حقوق شهروندي از سوي پليس و مراحل مذكور وجود دارد و اين نشان دهنده آن است كه ضابطين در خصوص آنها عملكرد خوبي را دارند و حقوق شهروندي را رعايت ميكنند.

The main objective of this study was to investigate the extent to which the rights of the defendant were observed from the point of view of citizens, defendants and agents in the police stations of the city of Bonab. According to the existing laws, in particular the criminal procedure passed in 1392, by the police officers of Bonab city regarding the rights of the accused persons Is? This research is a descriptive survey that has been conducted field experiment. The statistical population of the study consisted of 50 law enforcement personnel in Bonab, 50 defendants in Bonab city, and 50 citizens who were in a police station and at the checkpoints were randomly selected. To collect information from A researcher-made questionnaire was used that included 50 questions. Validity of the questionnaires was obtained by the professors of opinion and reliability of the questionnaires with Cronbach's alpha. ANOVA test was used to analyze the data in addition to descriptive statistics indices. There is no significant relationship between the performance of the defendants at the subjective stage, arrest, interrogation and observance of citizenship rights. However, there is a meaningful relationship between the performance of the defendants in the process of summoning, attracting, checking and conducting local research, and observing citizenship rights. Police is an organization that is governed by the law and its powers are determined by law, including the pertinent duties of this institution in any society, conducting preliminary investigations with the coordination and supervision of a competent judicial authority. At the end of this paper, the results of the investigations showed that police in Bonab city did not have a meaningful relationship between policing and citizenship rights in the preliminary stages of arrest, subjugation and interrogation, which indicates that the defendants They do not have a good performance or do not respect them. Regarding the stages: summoning, attracting, inspecting, and conducting local investigations, there is a significant relationship between police compliance with the citizenship rights and these steps, which indicates that the defendants have a good performance and respect the rights of the citizen.
