بررسي جرم‌شناختي معافيت راشي از مجازات در پرتو سازوكارهاي كنوانسيون مبارزه با فساد (مريدا)

Criminalogy Investigation of Briber Exemption from Punishment according to the Anti-Corruption Conventions

راشي با پرداخت رشوه باعث بي‌اعتمادي مردم نسبت به حاكمان و حتي بي‌اعتمادي نسبت به يكديگر و رواج شك و سوءظن در جامعه مي‌شود و در پاره‌اي از موارد، منجر به ايجاد ناآرامي و تزلزل پايه‌هاي حاكميتي نظام مي‌شود. قانون‌گذار، راشي را تحت شرايطي معاف از مجازات مي‌داند. اين شرايط كه منجر به معافيت راشي از مجازات مي‌شود عبارت است از احقاق حق و اضطرار. سؤال اصلي كه در اين مقاله مورد بررسي قرار مي‌گيرد اين است كه اضطرار و احقاق حق در خصوص راشي مي‌تواند منجر به مصونيت او از پيگرد و مجازات شود و با توجه به ضروريات عصر حاضر و همچنين وجود تعهدات بين‌المللي در خصوص جرم رشوه، وجود اين مصونيت آيا با اين تعهدات و ضروريات قابل‌جمع هستند؟ با توجه به قواعد عام اضطرار در قوانين كيفري به نظر مي‌رسد حذف مواد مربوط به شرايط اضطرار در جرم رشوه مي‌تواند يك راه حل مناسب در جهت پيشگيري از وقوع اين جرم باشد.

Bribe-taker by paying the bribe causes distrust of people to the governers and even to each other and spreads the mistrust and suspicion the society and in some cases causes unrest and destabilisation of the foundation of the government system. Lawmaker exempts the bribe-taker about punishment under some condition. Those condition that make the bribe-taker free of punishment consist of giving the right and emergency. The main question in this article is that, can the emergency and getting the right about the brib-taker cause him not to be followed and being free of punishment and according to the necessities of nowadays and also regarding to the international obligations about the bribing's crime, are these obligations and necessities gather to each other? According to the emergency general ways in the disciplinary laws, it seems deleting some items about the emergency condition in the bribe crime, can be one suitable solution in case of preventing from this crime.
