توهين به اشخاص عادي از جمله جرايم عليه شخصيت معنوي افراد است. توهين به اشخاص از ديدگاه فردي و اجتماعي يك ضد ارزش مي باشد . با توجه به اينكه سالانه تعداد زيادي پرونده در دادسراها و شعب كيفري در خصوص اين جرم تشكيل مي شود و وقت و هزينه هاي گزافي بر نظام عدالت تحميل مي كند. در حالي كه به لحاظ مجازات يكي از پايين ترين ميزان مجازات ها را به خود اختصاص داده است. هدف از اين پژوهش بررسي علل وقوع اين جرم و راهكارها مناسب در اين باره مي باشد . روش مورد استفاده در اين مقاله، توصيفي و تحليلي و روش جمع آوري اطلاعات تحقيق، به شيوه كتابخانه اي و به صورت فيش برداري و مصاحبه از مطالب و تجزيه و تحليل آن خواهد بود. به طور كلي علل وقوع جرم توهين متاثر دو بعد فردي و اجتماعي است لذا راهكارهاي كيفري و پيشگيرانه نيز دو بعد فردي و اجتماعي خواهد بود البته ديدگاه اسلام نيز مي تواند در اين باره بسيار كابردي باشد.

insulting Ordinary People is one of the Crimes against people's spiritual personality. Insulting people from an individual and social point of view is an anti-value. according to that a lot of cases are filing in public prosecutor's offices and criminal branches annually and it puts the justice system to spend an exorbitant amount of money and time while in terms of punishments it has assigned one of the lowest amount of punishments. The purpose of this research is to study the causes of this crime's occurrence and appropriate solutions about it. the method that has been used in this paper is descriptive and analytic and the method of gathering information consists of the library research method in forms of taking notes and doing an interview about the matter and analysing it. generally the causes of the insulting crime's occurrence are affected by individual and social perspective;hence, the solutions also will be about the individual and social perspective. Indeed,in this case Islam's point of view will be very useful.
