چكيده فارسي :
اشكال مدرن بازي‌هاي رايانه‌اي قمار گونه قريب به بيست سال است كه تبديل به سرگرمي جهان‌شمول شده است. مي‌توان از هرجاي دنيا به سرورهاي آنلاين متصل شد و به بازي پرداخت. معضلي كه در اين زمينه مطرح مي‌شود اين است كه ازنظر حقوقي و كيفري انجام قمار رايانه‌اي داراي چه ضمانت اجرايي است و راه‌هاي پيشگيري از اين پديده به چه اشكالي ممكن است. روش تحقيق به شكل توصيفي- تحليلي بود و در اين راه روش گردآوري اطلاعات كتابخانه‌اي و با استفاده از ساير منابع مانند منابع رايانه‌اي صورت گرفتهاست. نتيجه مطالعات كتابخانه‌اي نشان داد كه شكل مبارزه با قمار آنلاين به‌وسيله فيلتر كردن سايت‌ها و مسدود كردن حساب‌ها و درگاه‌هاي بانكي تدبيري است جهان‌شمول، ولي در كشور ما با توجه به حرمت عمل قمار مي‌توان گفت اعمالي كه براي جهت دادن به اين موضوع همچون ساير نقاط جهان استفاده مي‌شوند در كشور ما نسخه شفابخشي نيستند فلذا مبارزه با درگاه‌هاي بانكي جعلي بدون شناسه و بالا بردن امنيت سايت‌ها ودومين‌هايي كه در اين عرصه مشغول‌اند، امري ضروري است. در يك نتيجه‌گيري كلي مي‌توان گفت مجازات‌هاي مندرج در قانون به نحوي بازدارندگي لازم را ندارند، زيرا هرروزه شاهد رشد روزافزون اين‌گونه از جرائم هستيم. حمايت قانوني از مال‌باختگان به‌صورت قضايي نيز لازم است. درست است كه اگر شخصي با ميل خويش به قمار پرداخت، مجرم است، اما پيشنهاد مي‌شود روش‌هاي قانوني براي استرداد مال وي انديشيده شود كه اين امر چه در مبالغ زياد چه كم سبب اين نشود كه شخص از شكايت به مجاري قانوني منصرف شود و سبب اين شود كه گردانندگان اين سايت‌ها در اين امر مصمم‌تر شوند
