بررسي مسئوليت مدني متصديان راه در تصادفات رانندگي

An investigation of road maintenance officials’ civil responsibilities in road

متصديان راه مانند وزارت راه و شهرداري وظيفه‌ي احداث و نگهداري و ايمن‌سازي راه‌ها را بر عهده دارند. در شرايطي كه نقص راه يا رعايت نكردن اصول ايمني از سوي آنان در تصادف رانندگي مؤثر باشد، مسئوليت آن‌ها به عنوان يكي از اسباب يا علت تام تصادف مطرح مي‌شود. در اين مقاله بر پايه‌ي قواعد مسئوليت مدني و قوانين خاص موضوعه‌ درباره‌ي مسئوليت آن‌ها و حدود آن بحث مي‌‌شود. مسئوليت مدني متصديان راه از دو منظر تحليل و بررسي مي‌‌شود؛ از يك طرف بر مبناي قواعد مسئوليت مدني و نظريه‌ي تقصير قابل بررسي است و از طرف ديگر با توجه به اين كه متصديان راه به ‌طور عمده به‌صورت مؤسسه‌ي دولتي يا عمومي هستند، تحليل موضوع بر اساس مسئوليت مدني دولت صورت مي‌گيرد. در اين شرايط، در كنار مسئوليت شخص حقوقي متصديان راه، بحث مسئوليت شخصي مأموران و كاركنان ادارات و مسئوليت انفرادي يا تضامني آن‌ها مطرح مي‌شود.

Road maintenance officials and organizations such as ministry of roads and municipalities’ duties is building and maintaining as well as securing the roads. In case the existence of a fault or not observing the safety rules by those in charge leads to a car accident, the responsibility is on them as one or only cause of the accident. Based on civil responsibility principles and other specific related laws, the present study tries to discuss the responsibilities and their limits. The officials’ civil responsibilities can be analyzed from two points of view. One, based on civil responsibility principles and the theory of fault and two, knowing that the road maintenance officials are mainly in public or governmental institutions, it can be done with regard to the civil responsibilities. In this condition, besides the legal personal responsibilities of road maintenance officials, the staff and employees’ individual responsibilities can be discussed too.
