Humanitarian Law and Dominance War

In the present study, while raising questions concerning the commitments and obligations of hostile parties during coalition invasion to Iraq or the third war of Persian Gulf, and attempt has been made to review and analyze the cases of violation of these commitments in the phase of aggression and defense stressing on humanitarian international law, that is, the Iaw of armed conflicts. According to these commitments, first of all the invading states (which, of course, disguise their act of aggression under the cover of lawful and legitimate right of self-defense and justify it under the pretext of authorization of UN security council) can not consider themselves as headstrong (self-willed), regardless of international rules and regulations, in dealing with and treatment of Iraqi people, their properties and even former Iraqi military personnels and government assets and Iraq national resources. Secondly, Baʹath regime defensive measures against aggression undertaken by Iraq also should be compatible to the rules of war and engagement in the kinds of war measures and the ways used and instruments applied as well as the support provided for the victims of the clashes.
