سازوكارهاي معاضدت حقوقي در دادرسي كودكان

معاضدت حقوقي در معناي گسترده آن شامل آن دسته اقدامات و تمهيداتي مي شود كه در جهت تحقق دادرسي عادلانه و حمايت از اقشار آسيب پذير با لحاظ نوع جرم ارتكابي و يا شخصيت مرتكب مي باشد كه از جمله اين اشخاص كودكان مي باشند. بنابراين بررسي حق برخورداري از معاضدت حقوقي در راستاي دادرسي هاي كيفري كودكان هدف اصلي اين پژوهش مي باشد. در اين پژوهش با روش توصيفي-تحليلي و با استفاده از منابع كتابخانه اي مباني فقهي و حقوقي و سازوكارهاي معاضدتي در دادرسي كودكان مورد بررسي قرار گرفته است كه مي توان به مواردي از قبيل سيره معصوم (ع)، امورحسبه، وجوب تعليم و ارشاد جاهل، لزوم احقاق عدالت و جلوگيري از خطاي قاضي به عنوان مباني فقهي معاضدت حقوقي اشاره نمود. افزون بر اين سازوكارهايي از قبيل ميانجي گري كيفري، مددكاري اجتماعي، لزوم حضور ولي، سرپرست قانوني يا وكيل در جلسه دادرسي و تشكيل پليس ويژه اطفال در راستاي تحقق معاضدت حقوقي نقش و اهميت غيرقابل انكاري دارند.

Legal aid in its widespread meaning includes those measures and Prolegomena, which are intended for the realization of fair trial and protection of vulnerable groups in terms of the type of crime or personality that are children. Therefore, investigating the right of legal aid to protect the child's life following the criminal procedure of children is the main objective of this study. In this research, using descriptive-analytic method and library resources of juridical and legal foundations and mechanisms in children's hearing, it is possible to have such cases as immaculate (as), the importance of education, necessity of teaching and foolish guidance, necessity of justice and preventing the judge's error the marking of legal aid is mentioned. In addition to these mechanisms such as criminal mediation, social work, the necessity of presence of the Guardian, legal guardian or lawyer during the hearing and the formation of a child police in line with the realization of legal assistance and undeniable important role.
