ضرورت و امكان‌ سنجي تأسيس ديوان كيفري بين‌المللي اسلامي از منظر حقوق بين‌الملل و اسلام

The Necessity and Feasibility of Establishing the Islamic International Criminal Court from the point of view of International law and Islam

انديشه ي مقابله با جنايات بين المللي، ذهن انديشمندان حوزه ي عدالت كيفري بين المللي را معطوف نموده است. امعان نظر در ماهيت نظام حقوق اسلامي مبيّن اين است كه محظورات كشورهاي مسلمان در مسير پيوستن به اساسنامه ي ديوان كيفري بين المللي، الحاق به ديوان و مقابله ي مؤثر با جنايات بين المللي مرتبط با كشورهاي اسلامي را تحت الشّعاع قرار داده است. بنابراين اهتمام كشورهاي اسلامي مبني بر انعقاد معاهده ي بين المللي جهت تأسيس ديوان بين المللي كيفري اسلامي كه به مثابه نهادي مستقل و دائمي، نظام قضايي كشورهاي اسلامي را تحت لواي نظام قضايي بين المللي مشترك قرار دهد، ضروري مي نمايد. در مقاله ي حاضر ضمن بررسي ضرورتهاي تأسيس ديوان بين المللي كيفري اسلامي و چالش هاي فرارو، ومقدمات لازم براي تاسيس ان درارتباط با ساير نهادهاي بين المللي، الگوي موفق حاكم بر تاسيس اين ديوان ارايه مي گردد.

Thinking about of dealing with international crimes has focused on the minds of international criminal justice thinkers. The attention to the nature of the Islamic law system shows that the obstacles of Muslim countries on the path to joining the International Criminal Tribunal's constitution, overshadowed the adherence to the tribunal and the possibility of effective coping with international crimes related to Islamic countries. Therefore, the efforts of the Islamic countries to conclude an international treaty to establish the Islamic International Criminal Court as an independent entity and permanent judicial system, regulating judicial regime of Islamic countries under joint international judicial regime, seems inevitable. In the present article, using a descriptive and analytical method, we examine the necessity and feasibility of establishing the Islamic International Criminal Court and its challenges, as well as the successful model governing its establishment.
