يكي از مباحث مهم در حوزه حقوق عمومي و فقه سياسي، تبيين گستره حكم حكومتي و مبناي موجهه‌ساز صدور آن است. كه بر اساس مطالعات صورت‌ گرفته به نظر مي‌رسد صدور حكم حكومتي به عنوان راهكاري اساسي براي حل معضلات و پديده‌هاي نو ظهور سياسي و اجتماعي در اختيار حاكم جامع‌الشرايط قرارداده شده است تا در شرايط مختلف بر اساس مقتضيات جامعه و در راستاي اداره اموركشور، تصميم متناسب را اتخاذ نمايد. اين تصميم البته به نوبه خود نيازمند توجيه است. مصلحت عمومي به عنوان منفعت مشترك تمام افراد به مثابه اعضاي جامعه همان مبنايي است كه صدور حكم حكومتي بر مدار آن صورت پذيرفته و توجيه مي‌گردد. از اين روست كه نمي‌توان و نبايد حكم حكومتيِ صادره بر مبناي مقتضيات روز جامعه و منافع واقعي يكايك اعضاي آن را به حوزه مباحات محدود دانست.
