مقاله حاضر ضمن احصاء انتقادهاي وارد بر قوانين مربوط به موادمخدر در كشور قصد دارد تاثير سوء آن در پيشگيري انتظامي از جرائم موادمخدر بررسي نمايد. در مقاله حاضر براي جمع آوري اطلاعات مربوط به پيشينه و مباني نظري از كتاب ها و مقالات تخصصي ، پايان نامه ها و سايت هاي اينترنتي استفاده شده است. بر اين اساس عدم تناسب مجازات هاي جرائم موادمخدر با يكديگر، وجود برخي ابهامات و ايرادات در قانون مبارزه با موادمخدر فعلي از جمله متناسب نبودن ميزان جريمه نقدي تعيين شده براي مرتكبين برخي از جرائم موادمخدر ، با توجه به سود حاصل از ارتكاب جرم توسط قاچاقچيان ،در نظر گرفته نشدن مجازات براي خريد وفروش و قاچاق بذر و گرز خشخاش و بذر و يا برگ كوكا و بذر شاهدانه به قصد توليد مواد مخدر ، استراداد وسيله نقليه حامل موادمخدر به صاحب آن ، پايين و ناچيز بودن ميزان مجازات تعيين شده براي خرده‌فروشان موادمخدر در قانون مورد بحث ، عدم پيش بيني مجازات براي جرائم موادمخدر در فضاي سايبري و بسياري از ايرادات قانوني ديگر، باعث عدم كارايي قانون مبارزه با موادمخدر در پيشگيري انتظامي از جرائم موادمخدر در كشور شده است ، لذا با برطرف نمودن موانع قانوني و مشكلات موجود مي توان گام مثبتي در زمينه پيشگيري انتظامي از جرائم موادمخدر برداشت
