بررسي ميزان اثربخشي مصادره اموال قاچاقچيان در مبارزه با جرائم سازمان‌ يافته مواد مخدر (مطالعه موردي استان كردستان)

Investigating the Effectiveness of Traffickers' Property Confiscation in Combating Organized Crime Case Study of Kurdistan Province

مصادره اموال در واقع به ‌عنوان يكي از راه‌هاي مقابله با جرائم و قدرت، از قديم مرسوم بوده و در حال حاضر نيز به‌ عنوان يكي از روش‌هاي مبارزه با مواد مخدر و ساير جرائم در قانون رسمي كشورمان گنجانده‌شده است. امروزه باندهاي مواد مخدر با اقدامات مجرمانه سودهاي سرشاري را به دست مي‌آورند و اين امر يك تهديد جدي براي كشور محسوب شده و مي‌تواند دستگاه‌هاي سياسي، اقتصادي و فرهنگي كلان كشور را تحت تأثير قرار داده و سپس به‌ مرور به ‌عنوان يك منشأ تهديدكننده امنيت ملي در كشور تبديل شود. انجام تحقيقات و پژوهش‌هاي علمي جهت انتخاب راه‌هاي درست و علمي و اتخاذ تدابير مؤثر جهت مقابله با اين پديده شوم بسيار حائز اهميت هست. لذا با انجام اين پژوهش‌ها مشكلات و نارسايي‌هاي اين حوزه بيشتر شناخته مي‌شود و تحقيق حاضر باهدف بررسي ميزان اثربخشي مصادره اموال حاصل از اعمال مجرمانه قاچاقچيان جرائم مواد مخدر صنعتي و سنتي، پيش سازها و روان‌ گردان‌ها در استان كردستان انجام گرديده است؛ اين تحقيق ازنظر نوع تحقيق كاربردي و بر اساس ماهيت و روش، كيفي و براي گردآوري دادها از روش دلفي و مصاحبه با خبرگان استفاده‌شده است. جامعه آماري شامل تعداد ده نفر از خبرگان و متوليان امر مبارزه با مواد مخدر در استان كردستان مي‌باشند و نمونه‌گيري از نوع تمام شمار مي‌باشد. نتايج اين تحقيق مشخص نمود كه انجام صحيح و دقيق مصادره اموال حاصل از اعمال مجرمانه و قاچاق مواد مخدر و پيش سازها مي‌تواند يكي از روش‌هاي خوب مبارزه همه‌جانبه با جرائم سازمان‌يافته مواد مخدر و ساير جرائم مانند پول‌شويي و تروريسم باشد. اگر شناسايي اموال و دارائي ‌هاي قاچاقچيان به‌ درستي انجام شود مي‌توان با اعمال قوانين مربوطه و توقيف آن‌ها ضربات جبران ‌ناپذيري بر پيكره قاچاق مواد مخدر، پيش سازها و روان‌ گردان‌ها وارد نمود.

The confiscation of property has, as a matter of fact, been customary as one of the ways to deal with crimes, and is now included as one of the methods of combating drugs and other crimes in the official law of our country. Today, drug gangs are gaining enormous gains through criminal acts, which poses a serious threat to the country and can affect the political, economic, and cultural institutions of the country and then become a source of threats to national security. Thus, it is very important to conduct scientific research in order to select the right and scientific ways and take effective measures to confront this ominous phenomenon. Therefore, by performing these researches, the problems and deficiencies of this area are more known and the present study was conducted with the aim of investigating the effectiveness of confiscation of property derived from the criminal offenses of drug traffickers in traditional and industrial drugs, precursors and psychotropic drugs in Kurdistan province. This research is qualitative in nature and method, and Delphi method and interview with experts were used for collecting data. The statistical population consists of ten experts and fighters in the field of drug abuse in Kurdistan province. Sampling is of the total number. The results of this study revealed that confiscation of property derived from criminal acts and drug trafficking and precursors could be one of the good methods of combating organized crime and other crimes such as money laundering and terrorism. If the identification of the smugglers' assets is done properly, they can impose irreparable blows on the trafficking of narcotics, precursors and psychotropic substances by enforcing the relevant laws and seizing them.
