سهم‌بري ابزار توليد از محصول؛ رويكردي فقهي‌- اقتصادي: با تأكيد بر انديشه‌هاي شهيد صدر

در طول فرآيند توليد، عوامل مختلف انساني و غير انساني دخالت داشته و بدون وجود آنها، شكل‌گيري و به ثمر نشستن تلاش­هايي كه در اين راستا انجام مي­گيرد، ممكن نخواهد بود؛ اما مسئلة قابل توجّهي كه در اين زمينه وجود دارد، ميزان اختصاص سود عمليات توليد به هر يك از اين عوامل است. در آثار فقهاي مذهب تشيع و همچنين در لسان اصحاب اقتصاد، نظرات متفاوت و يا متناقضي در مورد مشاركت يا عدم مشاركت ابزار توليد در سود محصول يافت مي­گردد كه هركدام از آن آراء، مستند به ادله‌اي قابل‌تأمل مي­باشند. بعضي فقها و متفكرين مانند شهيد صدر و امام موسي صدر سهم ابزار توليد را تنها در اجاره‌بها مي­دانند. در مقابل عده‌اي ديگر، قائل به مشاركت ابزار توليد در سود محصول نيز مي­باشندو سهم ابزار توليد را در محصول توليدشده مي‌دانند. اين مقاله به دنبال پاسخگويي به اين سؤال با تكيه بر آراء فقها به ويژه شهيد صدر است كه بيش از سايرين از منظر فقهي به اين مسئله پرداخته و نشان مي‌دهد كه مي‌توان براي ابزار توليد، علاوه بر اجاره آنها، سهمي از سود محصول را در نظر گرفت.

During the production process, various human and inhuman factors are involved, and without them there will be no way to formulate and work out the efforts made in this direction. But there is a significant issue in this regard, the amount of profit allocated to production operations to each of these factors. In the works of the Jurisprudents of the Shi'a religion, as well as in the language of the economy, there are different or contradictory views on the participation or non-participation of the means of production in the profit of the product, each of which are documented in considerations. Some people think that the share of the means of production is only rented, in contrast to others, in addition to rent, they also consider the participation of the means of production in the profit of the product. This article seeks to answer this question by relying on the opinions of the jurists, in particular the martyr Sadr (RA), who deals more with the jurisprudential aspect than others, and shows that it can be used for the means of production, in addition to renting The cost was considered as a share of the product's profit.
