پيدايش علم ژنتيك و انجام تحقيقات در خصوص ژنوم انساني و كاركردهاي جديدي كه بر اين موضوع متفرع شده است زمينه گفتگوهاي علمي مختلفي بين متخصصان واز جمله فقهاء بوجود آورده است و از آنجا كه علم فقه داعيه دار پاسخ دادن مسائل مورد ابتلاي مكلفين مي باشد،ضروري مي نمود كه در خصوص اين موضوع نيز ديدگاه فقها مورد توجه قرار گيرد. با رجوع به ديدگاه هاي ابرازي از سوي فقهاء بدست مي آيد كه اقوال مختلفي اعم از موافقت مطلق تا مخالفت مطلق شكل گرفته است كه در اين بين ادله ابرازي مخالفان به جهت آثار متفرع بر آن و نوع استدلال ارائه شده از جايگاه ويژه اي برخوردار شده است.آنچه اين تحقيق به دنبال پاسخ گويي آن برآمده است از يك سو تبين رويكرد فقها نسبت به اين موضوع و از سوي ديگر كشف چرايي مخالفت برخي ديگراز فقهاء با انجام تحقيقات ژنتيكي است. يافته هاي تحقيق حاكي از آن است كه دلايل موافقين علي رغم اختلافاتي كه در اين بين دارند از جايگاه قوي تري برخوردار است و آنچه به عنوان دليل مخالفت از سوي مخالفان اقدامات ژنتيكي مطرح شده بيش از آنكه يك دليل محسوب شود،حاكي از نگراني فقهي است؛ چرا كه انجام تحقيقات در زمينه ژنوم انساني مي تواند با سوء استفاده هايي همراه شود كه مي تواند كرامت انساني را با چالش مواجه كند. در عين حال ضرورت تبعيت از ادله فقهي نگاه اكثريت فقها را به سو ديگري سوق داده است كه مي تواند ضمن تامين وصيانت از كرامت انساني از سوء استفاده هايي احتمالي نيز جلوگيري كند .
