چكيده فارسي :
حقوق مالكيت ادبي و هنري در راستاي حمايت از مولفان و هنرمندان از يك سو و حمايت از حقوق جامعه (منافع عمومي) از سويي ديگر، به مولفان و هنرمندان حقوق انحصاري مي دهد. مولف مي تواند به استناد داشتن اين حقوق در مدتي موقت، از تجاري سازي اثر خود كسب درآمد نموده (حق مادي) و نام خود را به عنوان پديدآورنده براي هميشه در تاريخ و فرهنگ بشريت ثبت نمايد. (حق معنوي) قانونگذاران ملي و بين المللي، به گونه اي اين حقوق را براي مولفين تدارك ديده اند كه مانع سوء استفاده آنها از اين حق و تحديد حقوق جامعه مي شود. يكي از مصاديق حقوق جامعه، حق دسترسي به اطلاعات است. در نگاه اول به نظر مي رسد كه حق انحصاري مولف، محدود كننده اين حق جامعه باشد، اما با نگاهي به مباني مالكيت فكري به طور عام و مالكيت ادبي و هنري به طور خاص و همچنين بررسي دقيق مقررات ملي و بين المللي نتيجه مي شود كه نه تنها اين انحصار، تامين كننده سلامت و اصالت اطلاعات و محصولات فرهنگي بوده و از اين جهت با منافع جامعه همسو است، بلكه محدوديت ها و استثناهاي وارد بر آن نيز مانع نقش محدودسازي كپي رايت در دسترسي عموم به اطلاعات مي شود. علاوه بر اين پيش بيني حق معنوي براي مولف، اصالت و سلامت اطلاعات را در پي داشته و موجب برخورداري جامعه از اطلاعات اصيل و با منشا مشخص مي شود. در اين خصوص مفاد ماده 19 لايحه حمايت از مالكيت ادبي و هنري و حقوق مرتبط و مادتين 2 و 2 مكرر كنوانسيون برن در دو سطح ملي و بين المللي قابل توجه است.

Copyright grants authors and artists, exclusive rights to protect authors and artists, on the one hand and to protect community rights on the other hand. The author can, for a temporary period of time, earn from the commercialization of his work and register his name as the creator forever in the history and culture of humanity. National and international legislatives have provided these rights to authors in a way that prevents them from abusing this right and restricting the community rights. One of the examples of community rights is the right of access to information. At first glance, copyright seem to limit this right of society, but with a look at the foundations of intellectual property, in general, and at the foundations of copyright, in particular, as well as careful scrutiny of national and international regulations, concludes that not only does this monopoly guarantee the intactness and originality of information and cultural materials, and is in line with the public interests, but also the limitations and exceptions to it, impede the copyright restrictive role on the right of access to information. In addition, prediction of moral right of the author leads to originality and authenticity of information and enables the community to enjoy original and authentic information with a definite and certain source. In this respect, the provisions of Article 19 of the Bill on the Protection of Literary and Artistic Property and the Articles 2 and 2bis of the Berne Convention at national and international levels are significant.
