The Concept of Law in Ṭālebuf Tabrīzī’s Thought

مشروطيت، به عنوان حادثه‌ي مهم دوران جديد ايران، جنبشي براي تأسيس قانون بود. از عصر ناصري، همواره قانون هم در نوشته‌هاي روشنفكران، هم در خواسته‌هاي مصلحان و مردم مطرح مي‌شد. در دوران مشروطيت، ايرانيان درخصوص اين مفهوم كليدي دوران مدرن سخنان بسياري بيان كردند. يكي از منسجم‌ترين و دقيق‌ترين سخنان در خصوص اين مفهوم از آن ميرزا عبدالرحيم طالبوف تبريزي است. در اين مقاله كوشش شده است با بررسي نوشته‌هاي طالبوف، طرحي از مفهوم قانون در انديشه‌ي او معرفي شود. طالبوف به جايگاه قانون، تعريف آن، اهداف و فوايد قانون و نيز منبع وضع آن پرداخته و برداشت درستي از اين مفهوم در ايران ارائه كرده است. او همچنين كوشش كرده است به طرح ديدگاهي در مورد نسبت شريعت و قانون دست‌يابد.

Constitutionalism, as an important event in modern Iran, was a movement to establish the rule of law. Since the Naṡirī era, law has always been mentioned in the writings of intellectuals as well as in the demands of reformers and the people. During the constitutional period, Iranians said a lot about this key concept of the modern era. One of the most coherent and accurate statements about this concept is that of Mirza ‘Abdulraḥmān Ṭalebuf Tabrīzī. In this article, an attempt has been made to introduce a concept of law in his thought by examining Ṭalebuf’s writings. Ṭalebuf deals with the status of law, its definition, goals and benefits, as well as the source of its making and provides a correct understanding of this concept in Iran. He has also sought to come up with a perspective on the relationship between Sharī‘a and law.
