Analysing The law prisoners of War by the Islamic an‎d Muslims Jurists’ Standpoint

اسلام يگانه دين مترقي در بين اديان عالم است كه براي اولين بار اوضاع جنگ را سامان بخشيد و براي آن نظام بشردوستانه وضع كرد و براي اسيران جنگي حقوقي قائل شد. پيامبر اكرم صلي الله عليه و آله وسلم نيز در دنيا نخستين شخصيتي است كه قوانين عادلانه جنگ را به طور جامع بيان و در نبردهاي صدر اسلام رعايت كردند و براي اسيران حق حيات و زندگي را به رسميت شناختند. اسيران جنگي، در نظام جهاد اسلامي داراي حقوق شناخته شده اي هستند كه فراتر از حقوقي است كه در كنوانسيون هاي ژنو مقرر شده است.به اسارت گرفتن نيروهاي رزمنده دشمن اگر براي مقاصد تجاري و سوء استفاده از اسراي دشمن باشد، در قرآن به عنوان امري مخالف شئونات دين و رسالت انبياء تلقي شده است و اگر به منظور ناتوان كردن دشمن و وادار كردن طرف متخاصم به دست كشيدن از جنگ باشد، بي گمان مجاز بوده و در راستاي اهداف بشردوستانه جهاد قرار دارد.در مقاله حاضر قصد داريم با روشي توصيفي-تحليلي به بازشناسايي قواعد مترقي در آيات قرآن كريم، سيره رسول اكرم صلي الله عليه و آله وسلم و ائمه معصومين در زمينه رعايت حقوق اسيران جنگي در مقام نظر و عمل بپردازيم. چرا كه احترام به دشمن در ارزشهاي اسلامي يك التزام است؛ دين مبين اسلام مباني احكام خود را بر كرامت و اصالت انسانيت نهاده و صيانت از آزادي و حقوق مشروع انسان را به عنوان يك اصل مورد تاييد قرار داده و بر اين اساس انسان چه آزاد و چه اسير از حقوق مشروعي برخوردار است كه لازم الرعايه است.

P.O.W’s own known rights in the Islamic Jihad system that throws beyond the Geneva’s prescribed conventions. In Quran, Captivating the enemy’s combatants, in case of trade and mishaps’ purposes of prisoners of war has been considered counter to religious dignity and the mission of the prophets and if occurred in order to debilitate the enemy and enforcing the other part to surrender, of course it will be permissive and allowed according to Humanitarian objectives.
In the current paper, we are supposed to apply recognition and reconsideration of the advanced and progressive regulations held in the holy verses of Quran also what have been mentioned in the biography of Islamic sacred prophet and all other innocent later Imams (peace be upon them) by an analytical-descriptive method with regard to heeding the prisoners’ of war in theory and practice. Because, respect to enemy is one of requirements and obligations in this way; the Islamic mobin religion has established the principles of its rulings on munificence and gentility of human beings and commented protection of freedom also legitimate rights of humans as a confirmed principle, hence humans whatsoever captive or free, enjoy legitimate laws in which has to be obeyed.
