Right to Happiness

شادي براي بيشتر انسان هاي مضطرب امروز كه در غصه نداشته ها، كمبودها و فرصت هاي از دست رفته بسر مي برند و خود را در ميان انواع آلودگي هاي زيست محيطي، بيماريهاي عالمگير و چالشهاي مرتبط با وضعيت اقتصادي مي بينند يك نياز و ضرورت است. انسان ها محق به شاد زيستن هستند. اين پژوهش جهت تشريح حق بر شادي (Right to Happiness) به عنوان حقي مشترك ميان حقوق بشر و حقوق شهروندي، مفهوم شادي را تبيين و مباني نظري و حقوقي آن را بيان كرد. سپس نگاه قوانين ايران و اسناد بين الملل به شادي را مورد بررسي قرار داد با اين پرسش كه قوانين ايران، آن را به عنوان يك حق به رسميت شناخته اند؟ به چه ميزان اسناد بين المللي به حق شادي انسان ها توجه نموده اند؟ فرضيه پژوهش اين بود كه قوانين ايران به طور پراكنده به شادي و نه به عنوان يك حق پرداخته اند و ضعف در اين زمينه بيشتر در رفتار و عملكردها وجود دارد. حق بر شادي در اسناد بين المللي به صورت موردي و با پرداختن به حقوق سياسي، اقتصادي، اجتماعي و فرهنگي مورد توجه قرار گرفته است.

Happiness for anxious people of today, who are in grief for deficit and missing opportunities and lives in a variety of environmental pollution, are necessary. Human entitled to live happily. This Article seeks to define the concept of happiness in order to explain the citizens happiness right as a common right between human rights and civil rights, and explicated its theoretical and legal foundations, then examined the right of happiness in Iran's laws and international documents with the question that what the value of happiness in Iran's laws is? and is it recognized as a right? How much international documents have paid attention to human happiness? The research hypothesis was Iran's laws have not considered happiness properly and there is a lack of legislation and more in the function of the authorities. The Right of Happiness in International documents is almost regarded to political, economic, social and cultural right.
