رويكردي تحليلي بر سازكارهاي مبارزه با «بيوتروريسم كرونا ويروس» در اسناد بين‌المللي و قوانين و مقرات داخلي

An Analytical Approach to Corona Virus Bioterrorism Mechanisms in International Documents and Internal Rules and Criteria

اين روزها، كرونا ويروس و سير صعودي افزايش تعداد مبتلايان و كشته هاي آن، اذهان عمومي كشورهاي جهان را به خود مشغول كرده است. از همان ابتداي شيوع آن در چين، سپس در سراسر جهان تحليل هاي زيادي درباره بيولوژيكي بودن آن منتشر شد كه كرونا ويروس يك جنگ بيولوژيكي و مصداق بيوتروريسم است. چراكه پيامدها و گستره بيوتروريسم به گونه اي است كه مي تواند منابع حياتي يك كشور را به نابودي بكشاند. به همين منظور امروزه به شدت مورد توجه مراكز راهبردي نظامي، سياسي، دفاعي، اقتصادي و بهداشتي جهان قرار گرفته است. پژوهش پيش رو با هدف «بررسي وضعيت مقابله با بيوتروريسم كرونا ويروس در قوانين داخلي و اسناد بين الملل» با استفاده از روش توصيفي-تحليلي و گردآوري اطلاعات به شيوه كتابخانه اي- اسنادي انجام گرفته است. نتايج نشان داد كه در نظام حقوقي ايران جرم مستقلي تحت عنوان بيوتروريسم به عنوان جرم اصلي وجود ندارد، اما در قوانين متعدد جلوه هايي از مفهوم تروريسم زيستي يافت مي شود كه به دليل سرعت عمل كند قانون گذار، نبود نگاه افتراقي به بيوتروريسم، ضعف ضمانت اجرا و غيره سازكارهاي مبارزه با آن، كارآمد و به روز نيست به طوري كه نيازمند بررسي و تصميم گيري هاي جديد است. در اسناد بين المللي نيز تدابيري كه براي مبارزه با آن انديشيده شده نياز به تكميل و اصلاح قوانين بين المللي از لحاظ داشتن ضمانت اجراي قوي و پيش بيني يك سيستم راستي آزمايي كارآمد و فني، لازم و ضروري به نظر مي رسد.

These days, the coronavirus and the rising number of infected people and its deaths have preoccupied the public in the world. From the beginning of its spread in China, and then around the world, a lot of analysis has been published about its biological nature, and Coronavirus is a biological warfare and an example of bioterrorism. The main question is, if the hypothesis of a biological war against our country is proved, what are the legal levers to deal with it in domestic law and international documents? Leading research has been conducted with the aim of "examining the state of coping with Coronavirus bioterrorism in domestic law and international documents" using descriptive-analytical methods and data collection in a library-documentary manner. The results showed that in the Iranian legal system, there is no independent crime under the heading of bioterrorism as the main crime, but in various laws there are manifestations of the concept of bio-terrorism that due to the speed of the legislature, lack of differentiated view. Bioterrorism, the weak guarantee of the implementation of anti-Semitism mechanisms, is not as effective as it needs to be in new research and decision-making. The need to complete and improve international measures also seems necessary in terms of having a strong implementation guarantee and anticipating an effective and technical truth-testing system
