تزاحم حق بر محيط زيست انسان با حق بر توسعه از منظر شريعت

On the Conflict between Human’s Rights of Environment and Development from the Perspective of Divine Law

يكي از معضلات حوزه محيط زيست، تزاحم ميان حق بر محيط زيست و حق بر توسعه است. زيرا از سويي توسعه در ابعاد گوناگونش براي زندگي بشر اجتناب ناپذير است و از سوي ديگر، اغلب، توسعه به تخريب محيط زيست مي انجامد. سازمان ملل براي حل اين مشكل در ميثاق هاي متعدد بين المللي، همانند اعلاميه استكهلم و اعلاميه ريو، «اصل توسعه پايدار» را به عنوان راه حل مطرح كرده، كه حفظ محيط زيست و تامين نيازهاي نسل هاي آينده از محورهاي اساسي آن است. در اين نوشتار با بررسي آيات، روايات، قواعد فقهي و روش عقلا، ضمن تبيين ديدگاه شريعت درباره جايگاه حق بر محيط زيست و حق بر توسعه، نارسايي هاي «اصل توسعه پايدار» را نشان مي دهيم و ثابت مي كنيم كه راه حل واقعي تزاحم اين دو حق، توسعه عدالت محور اسلامي است. نهادينه سازي قداست محيط زيست، اخلاق محيط زيست، احكام محيط زيست، حقوق محيط زيست اسلامي و نيز عدالت سيستمي و جهان شمول، عدالت ميان نسلي و عدالت درون نسلي از محورهاي اساسي توسعه عدالت محور اسلامي است.

The conflict between human’s right of environment and his right of development has been amongst intricacies in the field of environment because, on one hand, the development is inevitable for human life and on the other, development almost results in the destruction of the environment. Therefore, to solve this problem, the United Nations has underscored the principle of sustainable development in many international treaties including declarations of Rio and Stockholm in which protecting the environment and securing the needs of the coming generations is axiomatic. Studying Quranic verses, tradition and views of scholars, the current study has explained the view of divine law on this conflict and uncovered the inefficiencies of the principle of sustainable development. It is also suggested that the solution to the conflict resides in the Islamic justice-based development. Institutionalization of the holiness of environment, environmental ethics, environmental religious commandments, Islamic environmental law, universal and systematic justice, and intra-generation justice are amongst the principles of Islamic justice-based development.
