شهيد صدر در «اقتصادنا»، براي كشف نظريات مكتبي به منابع اوليه (كتاب و سنت) يا منابع ثانويه (فتاوا و مفاهيم) يا تركيبي از اين دو استناد مي كند؛ درحالي كه در تشريح عمليات كشف تصريح مي كند كه نظريات اسلامي را براساس احكام شرعي و مفاهيم كشف مي كند. در اين مقاله، با استشهاد به عملكرد وي و براساس تحليل هاي اصول فقه و فلسفه علم، درباره روش صحيح استناددهي در شناخت نظريات مكتبي قضاوت مي شود. براي استناد به منابع اوليه يا ثانويه در كشف نظريه هاي مذهبي، فرضياتي قابل طرح است: 1. تفكيك بين نظريه مذهبي و منبع آن، در مراجعه به منابع ثانويه و اوليه؛ 2. تفكيك بين انواع نظريه مذهبي در مراجعه به منابع اوليه و ثانويه؛ 3. رجوع به منابع ثانويه در فرض عدم دسترسي به منابع اوليه؛ 4. رجوع به منابع اوليه در فرض نبود منابع ثانويه. فرضيه يك و دو، مردود، فرضيه سه، قابل پذيرش و فرضيه چهار، مقبول است. فرضيه چهار، مبتني بر رتبه بندي بين علوم، تقدم ثبوتي «فقه نظريه» بر «فقه احكام» و تأخر اثباتي «فقه نظريه» از «فقه احكام» است. دوگانگي بين حكم واقعي و ظاهري، خدشه اي به صحت عملكرد شهيد صدر در استناد به منابع ثانويه وارد نمي كند.

To cite primary or secondary sources in the discovery of religious theories, the following assumptions can be made: 1.The distinction between religious theory and its source, in reference to secondary and primary sources.3.Separation between types of religious theory, in reference to primary and secondary sources.3.Refer to secondary sources assuming no access to primary resources.4.Refer to primary sources if there are no secondary sources. Hypotheses one and two are rejected, hypothesis three is acceptable, and hypothesis four is acceptable. Hypothesis four is based on the ranking between sciences, the affirmative precedence of"jurisprudence of theory"over"jurisprudence of rulings" and the positive delay of" jurisprudence of theory" from "jurisprudence of rulings".The dichotomy between real and apparent judgment does not impair the validity of Shahid Sadr's performance in citing secondary sources.
