Iranian Criminal Policy in the Light of New Right Criminology With an emphasis on security in the cultural system

زمينه و هدف: سياست كيفري مبتني بر راست نو، با اعتقاد به ناكارآمد بودن سياست‌هاي پيشگيرانه‌ي باليني، مهار جرايم را تنها از گذر سختگيري كيفري ممكن مي‌داند، سياست هاي نئوليبرالي جناح راست، طي فرايند جهاني شدن، تأثير خود را بر سياست عمومي دولت ها و در نتيجه نظام عدالت كيفري نهاده است. دولت ها در ايران، در بحران هاي اقتصادي، راهي جز جهت گيري به نظام سرمايه داري و اتخاذ راهكارهاي سياسي، اقتصادي نئوليبرال نديدند، اين در حالي است، كه توسعه اقتصادي بر مبناي اقتصاد آزاد، سبب خلق نظامِ ارزشيِ «سرمايه داري ليبرال» شده و شقوق فرهنگي- اجتماعي كشور را، دستخوش تغييراتي قرار داده است، از اين نظر، رويكرد امنيت مداري سياست كيفري، به حوزه فرهنگ نيز تسري پيدا كرده است. البته عواملي چون تمايلات عوامگرايانه و توده گرا نيز، در سختگيري كيفري درحوزه فرهنگ، بي تأثير نبوده اند. روش‌شناسي: در اين تحقيق از روش توصيفي ـ تحليلي به عنوان روش پژوهشي استفاده شده است و ابزار گرد آوري داده‌ها ي كتابخانه اي و اسنادي است. يافته ها و نتيجه گيري : يافته هاي پژوهش حاكي از آن است كه ارتباط معناداري ميان سياست كيفري ايران و انديشه جرم شناسي راست نو، مبتني بر سياستگذاري هاي اقتصادي وجود دارد. كليدواژه‌ها

Governments in Iran, in economic crises, saw no other way than to turn to the capitalist system and adopt neoliberal economic, political solutions, while free economic development created a "liberal capitalist" value system. an‎d it has changed the cultural and social dimensions of the country. In this respect, the security approach of criminal policy has also extended to the field of culture. Of course, factors such as populist and mass-oriented tendencies have also had no effect on the criminalization of culture. The findings of the study indicate that there is a significant relationship between Iran's criminal policy and the idea of modern right-wing criminology based on economic policy making. This research is applied in terms of its purpose and in terms of its nature and method, it is descriptive-analytical, the necessary information is gathered and analyzed in citation and library.
