چكيده فارسي :
حكومت اخلاق در خانواده اصلي بنيادين است و محوري ترين موضوع نهاد خانواده را تشكيل مي دهد. خدمت همسر يا مادر، در منزل با انگيزه مهرباني و فداكاري همراه است و صحبت از حق الزحمه درباره اين تكاليف اخلاقي نارواست. ولي اگر بخواهيم از جنبه حقوقي به بحث بپردازيم با سؤالاتي مواجه خواهيم شد كه اين تحقيق درصدد پاسخ به آن است.
اجرت المثل يكي از مصاديق حقوق مالي زوجه محسوب مي گردد كه در كنار حقوق مالي ديگر مانند مهريه، نفقه و... قابل مطالبه از سوي زوجه است. در حقوق اسلام و ايران زوجه در زندگي زناشويي وظايف معيني نسبت به زوج دارد، زوجه غيراز اين تكاليف، وظايف ديگري در قبال شوهرش ندارد.
اجرت المثل از حقوق ويژه اي است كه شرع و قانون براي زنان در نظر گرفته است. چنانچه زوجه به دستور زوج كاري غير از وظايف زناشويي را انجام دهد، در حالي كه عرفاً براي آن حق الزحمه اي تعلق گيرد، استحقاق دريافت اجرت آن را دارد، مگر اين كه ثابت شود زوجه كارهاي مزبور را به قصد تبرع انجام داده است.

The Remuneration of a Spouse during Matrimonail Life with an Emphasis on Case Law
The rule of ethics in the main family is fundamental and forms the core of the family institution. Serving a spouse or mother is at the home with the motive of kindness and sacrifice and talking about the fees for these ethical duties is unwise. But if we want to discuss the legal aspect, we will have to ask questions that this research is trying to answer.
Remuneration is one of the examples of the financial rights of the wife, which, along with other financial rights like Mahre, Alimony and ... is demanded by the wife. In the law of Islam and Iran, a wife has married duties in certain marriages, but she has no other duties to her husband.
Remuneration is one of the special rights that sharia and law have for women. If the wife, on the orders of the couple, carries out work other than marital duties, while the ghosts receive a salary for it, it is entitled to receive the salary unless it is proven that the wife has done the work in order to satisfy her.
