اهميت پرداختن به موضوع حمايت از منابع طبيعي از جمله اراضي ملّي با توجه ماهيت و آثار و عوارض آن خصوصاً در جامعه ايراني، با توجه سرعت تخريب و تهديد عليه منابع طبيعي يكي از اولويت‌هاي مورد بررسي در حوزه سياست جنايي قضايي مي‌تواند باشد. همچنين با توجه به بيان مقام معظم رهبري (مدظله) كه بر پيشگيري در حوزه‌ي منابع طبيعي از جمله زمين‌خواري، تخريب جنگل‌ها و نظاير آن تأكيد فرمودند مي‌توان به ضرورت و اهميت تحقيق پي‌برد. پژوهش حاضر از لحاظ هدف جز تحقيقات كاربردي و مسأله محور است و نوع تحقيق توصيفي و تحليلي مي‌باشد. از آن جهت كه درمقام بررسي و ارائه راهكار براي يك مسأله اجتماعي تحت عنوان سياست جنايي قضايي درحوزه حمايت از منابع طبيعي است به دنبال بيان معايب و نواقص در اين حوزه مي‌باشيم. از اين‌رو با بررسي پيشگيري اجتماعي و وضعي در حوزه‌ي حمايت از منابع طبيعي و ملّي اولاً: مي‌خواهيم مشخص نماييم كه تا به امروز در حوزه‌ي منابع طبيعي و ملّي چه اقدامي قضايي در بعد غيركيفري صورت پذيرفته است كه به نظر مي‌رسد بايد در اين خصوص اهتمام جدي شود تا به بازدارندگي و پيشگيري از جرايم اين حوزه دست يافت دوماّ: به ارئه و بيان خلاءها و نواقص در اين موضوع بپردازيم. همچنين پيشنهاد مي‌شود تمام دستگاه‌ها با تدابير و سياست‌هاي قضايي مناسب و علمي با مشاركت سازمان‌ها در جهت نهاديه كردن فرهنگ حمايت از منابع طبيعي كوشيد.

Firstly, we want to determine what judicial action has been taken in the area of natural and national natural resources in the field of non-refoulement, which seems to be a serious concern in this regard. To prevent and prevent crime in this area. Secondly, we will address the issues of deficiencies and deficiencies in this area. It is also suggested that all devices, with the appropriate legal and scientific policies and practices, cooperate with NGOs to institutionalize the culture of protecting natural resources.
