ديوان كيفري بين المللي و معيار شدت مندي‌؛ از چالش هاي نظري تا اشكالات عملي

International Criminal Court and Gravity Criteria; From Theoretical Challenges to Practical Problems

يكي از مكانيزم­ هاي مهم براي قابل پذيرش بودن يك وضعيت يا قضيه در ديوان كيفري بين­المللي، معيار شدت مندرج در ماده 17(1)(د) اساس­نامة رم است. عدم تعريف اين معيار در اساس­نامه باعث شده است كه نهادهاي ديوان مؤلفه­ هايي براي تشريح آن منتشر نمايند و ابهام آن را بردارند. اما اين معيار، در خود چالش‌هاي نظري دارد كه نيل به اهداف ديوان را با دشواري مواجه مي­نمايد. در كاربست اين معيار نيز برخي ناهماهنگي­ ها ديده مي­شود و گاهي مصلحت بر عدالت تغليب مي­يابد. در اين پژوهه، به چالش­هاي نظري و اشكالات عملي اين معيار پرداخته شده است. يافته­ هاي پژوهش نشان مي­دهد كه در كاربست معيار شدت‌مندي، رويكرد واحدي اتخاذ نشده است و ميان نهادهاي ديوان در تشريح اين معيار اختلاف نظر وجود دارد. اين مساله باعث اتخاذ تصميماتي شده است كه در عادلانه بودن آن­ها ترديدهاي اساسي وجود دارد و مشروعيت ديوان را با چالش مواجه مي­سازد.

One of the important mechanisms for the admissibility of a situation or case in the ICC is the criterion of gravity contained in Article 17 (1) (d) of the Rome Statute. The lack of definition of this criterion in statute has caused institutions of the court to publish factors for its explanation and remove its ambiguity. But this criterion has its own theoretical challenges that make it difficult to achieve the goals of the Court. In applying it, also some inconsistencies can be seen and sometimes expediency overrides justice. In this study, theoretical challenges and practical problems are discussed. The research findings show that in the application of this criterion, a single approach has not been used and there is disagreement among the institutions of court in explaining it. This has led to decisions in which there are fundamental doubts about their fairness, and challenges the legitimacy of the Court
