چكيده فارسي :
در دهه ي اخير استفاده از جنگ افزار هاي رباتيك به طور چشم گيري افزايش پيدا كرده است ، به طوري كه مناقشات مسلحانه آينده را به استفاده فزاينده از ربات هاي نظامي توصيف مي كنند .توسعه اين جنگ افزارها به عنوان يكي از دستاوردها نوين بشر نظام مسووليتي اعم مدني و كيفري را در سطح بين المللي به چالش كشانده است، به خصوص اعمال مسووليت كبفري را در قبال اقدامات غير قانوني سامانه هاي نظامي رباتيك مستقل به اشخاص كه نياز به احراز سوءنيت آنها مي باشد با چالش بيشتري مواجه است يا در مورد فرمانده نظامي براي اعمال مسووليت كفيري بايد كنترل موثر وي با توجه به آگاهي كه نسبت به كاركرد فني و برنامه ريزي اين جنگ افزارها دارد احراز شود، ولي به دليل اينكه برنامه ريزي اين جنگ افزارها با فرمانده نمي باشد و طراحي شده اند كه به طور مستقل عمل نمايند و بر مبناي برنامه و دستورات و محدوديت هاي كه به آنها داده شده تصميم مي گيرند بعيد به نظر مي رسد فرمانده نظامي بتواند اقدامات لازم براي جلوگيري از جنايات جنگي آنها به عمل آورد و درقبال جنابات آنها مسووليت كيفري داشته باشد.

In the last decade, the use of robotic weapons has increased. So that future armed conflicts are described by increasing use and reliance on military robots .The development of these weapons as one of the new achievements of humanity has challenged internationally leagl liability system. Particularly, the criminal liability for illegal acts of independent robotic military systems is more challenging for those who need to be proved of their intentional ,About the military commander, in order to exercise Criminal liability, her effective control must be exercised according to her knowledge of the technical operationand planning of these weapons. Given that the planning of these weapons is not with the commander and they are designed to act independently and decide based on the program and instructions and restrictions given to them. It is unlikely that the military commander will be able to take the necessary measures to prevent their war crimes and be held criminally liable for them
