چكيده فارسي :
اين گفتار با رويكرد فلسفۀ فقه و مبتني بر مباني فلسفي و كلامي مدعي است آنچه مي‌تواند بر پويايي فقه بيفزايد و حكمت ختم نبوت تشريعي را تبيين نمايد، تأمل در مبادي و ارائۀ فقه دريك نظام كارآمد است كه با امتياز انسجام دروني بتواند پاسخ‌گوي پرسش‌ها و نيازهاي انسان معاصر باشد. مبادي مزبور شامل مكتبي متشكل از مباني و اهداف است كه نوع تلقي انسان از جهان و انسان را شكل مي‌دهد و در اين چهارچوب است كه حقايق و روابط آن‌ها تفسير و فهم مي‌شوند. اين قالب فكري كه تجلي آن در منابع فقهي است، در مرحلۀ بعد، نظام ارزشي و رفتاري متناسب با خود را پديد مي‌آورد. نظام مزبور مبتني بر تعدادي اصول و قواعد است كه رفتارهاي اختياري انسان را هدايت مي‌كند، و نظام‌‌‌‌هاي اخلاقي، حقوقي و سياسي جامعه را شكل مي‌دهد. بنابراين منظور از سيستم يا نظام مجموعۀ دستورالعمل‌هايي است كه برايند عيني مباني، منابع و اصول هستند و در راستاي يك هدف جريان دارند. تأكيد ما در اين نوشتار درخصوص مولفه‌‌‌ها و ويژگي‌هايي است كه در پرتو دكترين ولايت و امامت، فقه اهل بيت (ع) را از ظرفيت نظام‌سازي برخوردار نموده است. رويكرد نظام‌مند و سيستماتيك بودن گزاره‌‌‌‌هاي فقهي، ضمن اينكه فقه ناكارامد را مبتني بر تفكر سكولار ارزيابي نموده، زمينۀ حضور مؤثر و حداكثري فقه اهل بيت (ع) را درعرصه‌‌‌‌هاي اجتماعي نيز فراهم مي‌نمايد.

This discourse with the jurisprudence philosophical and theological principles claims that what can be explained by the dynamics of jurisprudence, the explanation of the termination of the prophetic prophecy, is more precisely considered at the origins and presentation of jurisprudence in a system that is effective with the privilege of internal consistency by using the method of ijtihad Responding to the questions and needs of contemporary humans. In this regard, we will prove two things. First of all, from the context of the foundations and goals that we call school, it is possible to infer some general rules and principles. Second, based on the foundations and rules of the author and using The ijtih method came up with legal and legal propositions; Many will lead. The systems that are objective objectives of the foundations and goals will flow in the fields of economics, politics, law, etc. In the following, based on the meaningfulness and cognition of the concepts of jurisprudence, the theory of coherence will be fixed as an important feature of a legal system. The systematic approach of jurisprudential propositions, while evaluating inefficient jurisprudence based on secular thought, provides for the effective and maximum presence of the jurisprudence of the Ahlul-Bayt (as) in social terms.
