چالش‌هاي پيرامون مادة 637 قانون مجازات اسلامي مصوب 1375

جرائم منافي عفت عنوان عامي است كه شامل جرائم متعددي مي‌شود كه ازجمله آن‌ها رابطة نامشروع موضوع مادة 637 تعزيرات قانون مجازات مصوب 1375 مي‌باشد. قانون‌گذار در مواد 221 و 222 قانون مجازات اسلامي مصوب 1392 زنا را تعريف مي‌كند اما تعريف مشخصي از جرم رابطة نامشروع و عمل منافي عفت غير از زنا ارائه نداده است. عدم مشخص كردن حدود و ثغور منجر به ابهام درخصوص تعيين مصداق و آراي متناقص و متضاد درخصوص امور مشابه در مادة 637 شده است و مراجع قضائي در برخورد با مرتكبان اين پديده، برخورد يكساني نداشته‌اند. به‌نظر درصورت فقدان علقة زوجيت (اعم از دائم يا موقت) بايد روابط جنسي مادون زنا به‌صورت تماس فيزيكي و جسمي ميان زن و مرد مستوجب مجازات دانست و ارتباط‌هاي غيرجسمي را مصداق مادة 637 قانون مجازات درنظر نگرفت و بين آنچه كه حرام است و آنچه كه جرم است تفاوت و تمايز قائل شد.
