معيارهاي انتساب اعمال شورشيان به دولت در حقوق بين الملل

The Attribution of the Acts of the Insurgents to the State

در حقوق بين الملل طبق قاعده ي كلي رفتار شورشيان سازمان يافته به دولت منتسب نمي شود؛ زيرا آنها ارگان دولت محسوب نمي شوند و نيز دولت در موقعيتي نيست كه كنترل موثري بر فعاليت هاي آنها داشته باشد. اما موقعيت هايي وجود دارد كه رفتار شورشيان مي-تواند به كشوري كه در قلمرو آن فعاليت مي كنند و يا به كشور ديگر منتسب شود. حالت اول، زماني است كه دولت در مظان اتهام همكاري و يا ترك فعل در برابر اعمال زيانبار شورشيان قرار گيرد. حالت دوم، هنگامي است كه شورشيان طبق دستورالعمل و يا تحت هدايت و يا كنترل كشور ديگر عمل كنند كه در اين صورت ارگان بالفعل (de facto) و كارگزار آن كشور محسوب خواهند شد. در اين مقاله اين موضوع كه آيا ارتكاب اعمال شورشيان موجبات مسيوليت بين المللي دولت را فراهم مي آورد و هم چنين معيارهاي كنترل دولت مورد بررسي قرار خواهد گرفت. نتيجه گيري نويسندگان اين است كه چنانچه اعمال شورشيان به طور موثر توسط دولتي هدايت شوند قابليت انتساب به آن دولت را خواهند داشت.

Under the general rule, the conduct of the organized insurgents is not attributed to the State, because they are not the organs of the State and as such the State is not in a position to control effectively on their activities. But, there are situations that the conduct of the insurgents may be attributed to a country in whose territory they are acting or to the other country. The first case, is when the State is subject to cooperation charge or omission against the harmful actions of the insurgents. The second case, is while the insurgents act according to the direction or under the guidance or control of the other in this case, are de facto organ of that country. In this article, we discuss whether the conduct of insurgents may cause international responsibility of the State as well as the criteria of state’s control will be considered. The authors conclude that if the insurgents effectively conduct by a an state, their acts will be Attributed to that state.
