حمايت از حقوق محيط زيست در پرتو قواعد فقهي

در روزگار ما،بشر در شرايطي قدم به هزارۀ سوم مي‌گذارد كه با چالش‌هاي زيادي در زمينۀ محيط زيست روبرو است. آهنگ ناموزون تخريب محيط زيست يك نگراني جدي است.ابعاد اين بحران تمام جهان را دربرگرفته و سبب دلهره‌اي ژرف‌تر شده است. شرايط كنوني ايجاب مي‌كند كه در تمام بخش‌هاي علمي وغيره اقدامات فوري صورت گيرد، زيرا حاكميت و «سلطۀ انسان بر طبيعت» سبب مشكلاتي بعضاً درمان‌ناپذير شده است.اگرچه بشر از ابتدا به اهميت واحترام محيط زيست توجه داشته است، با پيشرفت علم و فناوري، طبيعت را مقهور خويش ساخت و با تغييري بنيادين در نگرش به محيط زيست، راه تسلط و بهره‌كشي روز‌افزون از طبيعت را هموار كرد. پس از انقلاب صنعتي و با بروز مشكلات و معضلاتي كه معلول استفاده از تكنولوژي است، محيط زيست به طور گسترده‌اي مورد توجه واقع شد، تا آنجا كه حفاظت از آن و جلوگيري از آلودگي آن يكي از مهم‌ترين مسائل اواخر قرن بيستم به شمار مي‌آيد. از طرفي از ديدگاه اسلام، حفظ طبيعت و تخريب نكردن آن يك وظيفۀ الهي، و آسيب به آن با توجه به منابع فقهي واصول و قواعد آن، موجب خسارت است. از اين رو در اين نوشتار سعي شده است، حمايت از محيط زيست با توجه به قواعد فقهي مورد بررسي قرار گيرد.

In our period , human steps to the third miliary in terms that contacts with a lot of problems about environment. unequal process of environment destruction, converts to an actual anxiety. dimension of this tension, encompasses the whole of the world and causes a deep presentiment. modern terms necessitates to form immediate proceedings in the all of science parts and etc. because government and human ascendancy of nature cazuses incurable problems. However, human attended to emphasising and regarding of environment uppermost; but with improvement of science and technology, human subdued the nature from himself and with a basic change in sight of nature, aggraded the way of domination and putting upon the nature. after of the industrial revolution and with accessioning the problems that is effected of using technology, the environment lionized widely, inasmuch as protection of environment and inhibition from destruction is one of the most important problems in 20th century. at the other hand, in islamic sight, protecting the environment is looked as a godly duty and destroying it causes reliefing the damage, as for jural resource and elements of it. therefore; in this research we tried to focus on protecting environmant as for jural rules.
