زمينه و هدف: آن‌چه مسئله‌آفرين است، اين است كه ماهيت جرايم نظامي چيست؟ و چگونه از جرايم عمومي تميز داده مي‌شوند. شايد پاسخ چندان دشوار نباشد و گفته شود جرم نظامي از جمله جرايمي است كه فقط نظاميان قادر به ارتكاب آن هستند. ليكن درباره نظامي بودن بعضي جرايم عمومي كه نظاميان هم ممكن است به ارتكاب آن متهم شوند ترديد وجود دارد. شايد بتوان گفت جرم نظامي عبارت است از قصور نظاميان در حفظ و انضباط و تخلف از وظايف خود كه به‌مناسبت شغل به آنها محول شده است. هدف از پژوهش تحليل و شناخت جرايم خاص نظامي از ساير جرايم عمومي جهت تشخيص مرجع صالح رسيدگي‌كننده و تعيين مجازات مناسب جرم ارتكابي است. روش تحقيق: اين پژوهش از نوع كتابخانه اي بوده و روش گرد آوري اطلاعات از طريق فيش برداري و جمع آوري اطلاعات كتب، رساله ها و تحقيقات موجود بوده است. نتايج و يافته‌هاي تحقيق: قانون‌گذار وظايف نيرو‌هاي مسلح را به دو بخش نظامي و غير نظامي (اعم از آن‌چه به‌عنوان ضابط دادگستري انجام مي‌دهند و غير آن) تقسيم كرده و تخلف از وظايف خاص را جرم نظامي تلقي و رسيدگي به آن را در صلاحيت محاكم نظامي قرار داده است.
