چكيده فارسي :
بر اساس نتايج به‌دست آمده بايد نيروهايي را ضابط دادگستري قلمداد كرد كه آموزش هاي لازم را ديده باشند و وظايف ضابطان دادگستري محدود به مرحله پس از وقوع جرم بوده و اقدامات ضابطان دادگستري در كشف جرم شامل دستگيري، مراقبت و ملازمت متهمان نيز مي شود. در قانون آيين دادرسي كيفري مصوب 1392، در راه هر چه تخصصي تر كردن وظايف ضابطان دادگستري گام فوق‌العاده‌اي برداشته شده است و در اين مقوله به مفهوم و ماهيت بازرسي و مصاديق و شرايط بازرسي در صحنه هاي مختلف و در صورت كشف جرايم جديد به نحوه رسيدگي آنها و به وظايف ضابطان بر اساس ماده57 قانون آيين دادرسي كيفري مصوب 1392 مي پردازيم. ماده 15 آيين دادرسي كيفري ضابطان دادگستري را هم تحت نظارت دادستان و هم تحت نظارت مقام قضائي (اعم از قاضي، دادستان، بازپرس، داديار و ...) دانسته است.
ضابطان دادگستري بازوي تواناي قوه قضائيه است كه در راستاي سياست كيفري قوه قضائيه به انجام امور مي پردازد و هدفي جز جلوگيري از جرم و درمان مجرم ندارد. با توجه به افزايش جمعيت در سال‌هاي اخير و پيچيده شدن جرايم، وجود ضابطان دادگستري به‌طور مستقل و فني ضروري مينمايد. روش گردآوري اطلاعات فيشبرداري از كتب، مجلات و نوشتارها، سايت هاي حقوقي و جمع آوري و بررسي آنها و ابزار گردآوري اطلاعات فيش هاي مطالعاتي، كسب نظر اساتيد دانشگاهي و عندالاقتضاء حوزوي و نيز مراجعِ دخيل در امور حقوقي و روش تجزيه و تحليل اطلاعات به‌صورت تحليلي ـ توصيفي خواهد بود.
