The Transformation Process of Crimes against Public Security in Iran's Criminal Laws

امنيت به‌عنوان يكي از نيازهاي فطري و ضروريات زندگي بشري نقش به‌سزايي در توسعه و پيشرفت جامعه دارد، امنيت عمومي يكي از بارزترين وجوه بالندگي يك اجتماع و بسترساز رشد و توسعه و ثبات جامعه مي‌باشد. استقرار امنيت عمومي در يك جامعه نيازمند ساختاري است كه در آن حداقل عناصري چون عدالت اجتماعي، تأمين و رفاه اجتماعي، اشتغال، آزادي و حاكميت مردم و مشاركت كامل آن‌ها، توزيع دانايي و اطلاعات در جامعه، اختلال اجتماعي، استفاده از نيروي فرهيختگان و دانايان، سازگاري اجتماعي و نظاير آن وجود داشته باشند. امنيت عمومي وضعيتي از تفوق نظم، قانون و رعايت عدالت در يك جامعه است كه شهروندان در سايه آن از تهديد و خطر در امان بوده و براي حفظ و پاسداري از حقوق خود و برطرف كردن زمينه‌ها و عوامل تعرض احتمالي- اطمينان خاطر دارند. اين تحقيق از نظر نتيجه توسعه‌اي و به روش كتابخانه‌اي و توصيفي و تحليلي با تجزيه و تحليل متون نگاشته شده و مطالعه كتب حقوقي در اين زمينه صورت گرفته است و هدف از آن بررسي سير تحولات جرايم عليه امنيت عمومي در قوانين كيفري ايران ميباشد. براساس نتايج به‌دست آمده جرايم عليه امنيت عمومي همواره و حتي در دوران انتقام خصوصي نيز جرم‌انگاري شده و در گذر زمان سير تحولي خود را طي كرده است هم‌چنين جرم‌انگاري اين اعمال به قبل از جرايم عليه امنيت خصوصي (فردي) مي‌رسد.

Security as one of inherent needs and necessities of human life a considerable role in development and advancement of the society. Public security is one of the most obvious dimensions of growth for a community and a channel for growth and development and stability of the society. The settlement of public security in a society needs a structure in which exists at least some elements such as, social justice, social security and welfare, employment, freedom and people's commandership and their complete participation, the spread of wisdom and information in the society, social disorder, usage of the power of the nobles and the wisdoms, social agreement and like that. Public security is a situation of order and law supremacy and justice observance in a society, under the shadow of which, the citizens are safe from threats and danger and they are sure for the purpose of preserving and guarding their rights and removing the potential backgrounds and factors of aggression. This research from the result point of view is developing and used library and descriptive analysis method and was done through analyzing the written texts and studying the law books in this field and its purpose is to study the evolutionary course of crimes against public security in Iran's criminal laws. According to the gained results, the crimes against public security and even in the periods of private revenge have always been criminalized, and with the passage of time, it has passed through its evolutionary course and also the criminalization of these actions reaches to the forepart of the crimes against private (personal) security.
