چكيده فارسي :
نزاع، از جمله جرايمي است كه در دسته جرايم خشن قرار مي‌گيرد كه با ايجاد اخلال در نظم و روابط اجتماعي، فضاي دشمني را در ميان افراد به‌وجود مي‌آورد كه با زمينه‌سازي براي ايجاد تنش‌هاي بعدي، جامعه و افراد جامعه را از نظر مادي و معنوي متضرر مي‌سازد. پديده نزاع تحت تأثير عوامل متعدد اجتماعي، رواني و زيستي است كه در اين زمينه تلاش‌هاي زيادي از سوي انديشمندان صورت گرفته است؛ بنابراين از ديدگاه حقوق دانان، جامعه‌شناسان و روان‌شناسان نزاع داراي مفاهيم مختلفي است.
از طرفي از ميان نظريه‌هاي جرم‌شناسي، برخي از نظريه‌ها به‌خوبي نزاع را مورد تبيين قرار داده‌اند، در حالي كه ساير نظريه‌ها قابل تعميم به نزاع نيستند. پژوهش پيش‌رو يك تلاش توصيفي- تحليلي با استعانت از منابع اسنادي و كتابخانه‌اي مي‌باشد كه با هدف تبيين مفاهيم و نظريه‌هاي نزاع و درگيري به نگارش درآمده است. نتايج اين پژوهش نشان مي‌دهد كه نزاع يك مفهوم پيچيده حقوقي، جامعه‌شناختي، روان‌شناختي و زيست‌شناختي است و نظريه‌پردازان اين حوزه، علل و عوامل آن را از ابعاد مختلفي مورد تحليل قرار داده‌اند كه هر كدام در بروز اين پديده اجتماعي سهم به‌سزايي دارند.
چكيده لاتين :
Dispute is from those crimes that are placed in the category of cruel crimes which creates the space of enmity among people through creating sabotage in social order and relations and would hurt the society and its people both materially and spiritually through providing the grounds for next tensions. The phenomenon of dispute is under the effect of various social, mental and biological factors that the intellectuals have made so much effort in this ground. Nevertheless, from the viewpoint of the lawyers, sociologists and psychologists the dispute has various concepts and meanings. From the other side, from among the criminology theories, some of them have clarified the dispute very well, while, other theories are not generalizable to the dispute. Present research which is a descriptive-analysis effort has used documentary and library sources that have been written with the aim of clarifying the concepts and theories of dispute and conflict. The results of this research show that dispute is a complex legal, sociological, psychological and biological concept, and the theoreticians in this field have analyzed its reasons and factors from different dimensions.
