بررسي نقش ايجابي پليس به‌عنوان يكي از نهادهاي عدالت كيفري در اجراي عدالت ترميمي

An examination of affirmative role of police as one of the criminal justice in administring restorative justice

در عصر حاضر، كشورها با افزايش جرايم روبه‌رو شده‌اند كه اين امر باعث ناامني و بي‌اعتمادي به پليس در جامعه شده است. در مورد مقابله با اين ناامني و بي‌اعتمادي دولت‌ها تصميم به تمركززدايي از پليس و هم‌چنين قائل شدن نقش مهمي براي جامعه در مبارزه با جرايم شدند. هم‌چنين نياز جامعه كنوني به الگوي پليسي متفاوت با الگوي پليس سنتي، الگوي پليس ترميمي براي پاسخ به اين نيازها شكل گرفت. در همين راستا، پژوهش حاضر نيز با هدف بررسي نقش ايجابي پليس به‌عنوان يكي از نهادهاي عدالت كيفري در اجراي عدالت ترميمي و با روش توصيفي و تحليلي و كاربردي و به روش كتابخانه‌اي و گردآوري اطلاعات از كتاب‌ها و مقالات معتبر فقهي و حقوقي انجام گرفت. نتايج حاصل از پژوهش نشان مي‌‌دهد كه پليس سنتي با اقدامات سركوب‌گرانه خود در تأمين هدف مبارزه با جرايم موفق عمل نكرده است. بدين معنا كه اقدامات انجام گرفته توسط پليس و سيستم رسمي رسيدگي، برچسب مجرمانه‌اي به بزهكار الصاق مي‌‌كند كه اصلاح و بازگشت وي به جامعه را با مشكل روبه‌رو مي‌كند در نتيجه، اين امر منجر به تكرار جرايم مي‌‌شود. در حالي كه پليس، در رويكرد جديد جامعه‌محوري خود از مشاركت مردم در تأمين نظم و امنيت و مبارزه با جرايم استفاده مي‌كند. در اين راستا برنامه جديدي به نام پليس ترميمي به پليس جامعه‌محور ارائه مي‌شود در اين برنامه پليس با استفاده از روش‌هاي ترميمي مانند ميانجي‌گري و نشست و با مشاركت جامعه، بزهكار و بزه‌ديده را در كنار هم قرار مي‌دهد تا از طريق مسئوليت‌پذيري و ايجاد شرمساري بازپذيركننده در بزهكار از تكرار جرايم پيشگيري كند.

Nowadays, countries are faced with the problem of increased crime levels, leading to lack of security and trust in police force. To tackle with this issue, governments have decided to shift their attention from police force and towards the society as an important factor for combating crime. Moreover, given the present society’s need for a police model different from the tradition one, the restorative police pattern was established to satisfy this need. To this end, the present study was conducted to examine the affirmative role of police as one of the criminal justice institutes in administrating restorative justice. Also, the present study used a descriptive, analytic, and applied method as well as a library and field-based one which made use of legal books and articles. According to the findings, police has not been successful in combating crime by means of suppressive measures. That is, actions taken by police and official systems attach a criminal label to the criminal which makes it difficult for him/her to rehabilitate and return to the society, leading to relapse of crime. However, with regard to the new society-oriented model police makes use of people’s cooperation in establishing order, security and safety. To this purpose, a new pattern called restorative or society-oriented police program is introduced in which the criminal and the victim are aligned using mediatory and cooperative sessions so as to prevent crime through accountability and recurring embarrassment in the criminal.
